Official Information Act (1982) requests 
 
I write in in regard to your Official Information Act Request that we recently received.   
 
On 24 April, we advised you that we required an extension of time to provide responses to multiple 
OIA requests for information related to CMDHB facilities and infrastructure. In particular, this 
requirement  relates to retrieval of archived documents/ correspondence  and reports.  We  are 
continuing to work on the retrieval and col ation of the specific information you have requested under 
the OIA for release to you. 
 
In the interim, we wish to advise that we have reviewed the minutes related to the facilities papers 
presented in Board Meeting ‘public excluded’ agendas in 2016-17, that were initial y withheld in our 
release on 19 March 2018.   
 
The documents are Minutes from the 5 Board meetings, covering 6 papers that were presented to the 
Board.  The Strategic Assessments have previously been provided to you. 
 
We acknowledge the material is in a number of respects also historical with events having moved on, 
with certain matters now in the public domain (for instance, the $3M settlement figure from the 
recent settlement with Hawkins and conclusion of negotiations with Hawkins for building remediation 
work). We note that: 
•  There are few other credentialed construction firms who could do this work; 
•  Time was against the DHB in returning to undertake a market exercise; and 
•  The DHB  involved professional advisors at each stage to “test” the deal on offer,  and the 
ultimate contract and its management of the risks faced by both Hawkins and the DHB; and 
•  Crown approval for the funding required also placed constraints on any approval –  these 
constraints were satisfied. 
 
This advice on these available documents does not diminish our obligations under the Official

release to you of  the specific information/ material and details that  you have requested under the
