Family Court History

Shannon Marshall made this Official Information request to Ministry of Justice

The request was successful.

From: Shannon Marshall

Dear Ministry of Justice,

Can you please advise how many days the longest recorded family court case in NZ has been? If you have a list of the top 8 cases and how many days they went for it would be much appreciated.

Also, who would I contact at the NZ Police about investigating a white collar crime (potential fraud)?

Yours faithfully,

Shannon Marshall

Hi Shannon

Further to Claire's email this morning, under section 15A of the OIA, we'd like to clarify your request.

The Family Court deals with applications and cases under a variety of legislation dealing with the care of children, relationship property, dissolution of marriages and civil unions, guardianship, Hague Convention, and care and protection proceedings.

We wondered if you were particularly interested in applications under the Care of Children Act? It would be good if you could specify what types of matters you're interested in.

Also, it might be easier to frame your request in terms of the length of time taken to deal with "applications". The reason is that "cases" will be reopened if new applications are received (e.g., for a parenting order) and for some matters, e.g., care and protection proceedings (under the Oranga Tamariki Act) are reopened at least once each year for a review, until discharged or the young person turns 18. In other words, a "case" might take a long time because it is required by law to be regularly reviewed.

While the Family Court has existed since the early 1980s, our database only includes full data from 2004 so we can only answer from that time onward.

We would appreciate if you could clarify your request as outlined above.

Cheers
