In the recent recruitment process to appoint a new Governor of RBNZ (which resulted in the Board recommending to the Minister of Finance that Adrian Orr be appointed as Governor), please advise:
1. How many of the total applicants/individuals considered for the role were:
a) women; or
b) non-Pakeha; or
c) both.

2. What was the total number of applicants/inidividuals considered?

3. If there is a shortlisting process, how many of the individuals who were included on that shortlist were:
a) women; or

On 12 December 2017 the Reserve Bank of New Zealand has received your
request, made under the terms of section 12 of the Official Information
Act (the OIA), seeking:

 

In the recent recruitment process to appoint a new Governor of RBNZ (which
resulted in the Board recommending to the Minister of Finance that Adrian
Orr be appointed as Governor), please advise:

1. How many of the total applicants/individuals considered for the role

3. If there is a shortlisting process, how many of the individuals who

on the shortlist in total?

 

The Reserve Bank is extending the time limit for a decision on your
request to 16 February 2018, as permitted under section 15A(1)(b) of the
OIA, because consultations necessary to make a decision on the request are
such that a proper response to the request cannot reasonably be made
within the original time limit.

 

You have the right, under section 28 of the OIA, to make a complaint to
the Ombudsman about the Reserve Bank’s decisions relating to your request.

On 12 December 2017 the Reserve Bank received a request from you, via

In the recent recruitment process to appoint a new Governor of RBNZ (which
resulted in the Board recommending to the Minister of Finance that Adrian
Orr be appointed as Governor), please advise:

1. How many of the total applicants/individuals considered for the role
were:

a) women; or

b) non-Pakeha; or

3. If there is a shortlisting process, how many of the individuals who
were included on that shortlist were:

Decision

 

The Reserve Bank is declining your request, as allowed by section 9(2)(a)
of the OIA, in order to protect the privacy of the candidates considered
for the role of Governor.

 

Given the nature of the process and the final pool of candidates,
releasing the information that you have requested is likely to identify
people who were considered but not appointed – which is private
information. 

Other information

 

It is worth noting that Governor designate Adrian Orr described his Cook

Under section 28 of the OIA, you have the right to seek a review of the

I'm surprised that the Bank believes that revealing sum totals would indirectly those who were "considered but not appointed" to the role of Governor. I know New Zealand has a small pool of those with the talents to be Governor, but I still think it is a leap of faith to assume that this will somehow inadvertently identify specific persons who applied.

I am not convinced that 9(2)(a) of the Act applies in this instance. I would need to know more about the Bank's concerns to determine what the strength of privacy interest was here and whether it was "necessary", in terms of 9(2)(a), for the information to be withheld.

Their response presupposes that there were women and non-Pakeha considered for the role.

Did they consult with applicants during this time to ascertain whether their privacy would be impacted or was the time taken to consult internally as to whether there what the mix of applicants were and if there were too few that could lead them to be identified?

I am very disappointed that the Bank erred in its original decision as it was such an egregiously incorrect decision. In addition, the overly lengthy time it took to provide you with the information added to the deficiency of the Bank's handling of your request. I do appreciate that the Bank has realised it was wrong to withhold the information and has apologised for the deficient way in which it handled your request. However my confidence in the Bank's decision making on OIA requests has been undermined by this particular case.
