Dear New Zealand Police,
On the 10th and 11th of October 2017 there is an event in Wellington which in previous years has seen Police action against peace protesters, the NZDIA Weapons Expo.
I would like to request copies of written documents, reports, memos, plans, letters, notes, emails and draft documents and photography (including digital and conventional; still and video) held by the police now or at any time in the next month in relation to this event or to actions potentially believed to be directed towards it.
I would like the content in the highest quality available to the police. For photography, this means the highest resolution images with EXIF and other metadata; for documents this means original emails, word or PDF documents rather than scanned paper documents. Metadata in these documents is part of what I am requesting.
In the case that some material is refused due to on-going police action(s), I request a multiple-part response, that material not covered being sent as soon as practically possible, and that material covered as soon as the related action(s) has terminated.

Hello Stuart
I refer to your OIA request dated 7^th October.
I note that you have made a broad request for written documents, reports,
memos, plans, letters, notes, emails and draft documents and photography.
In order to fulfil this request in full there would be a significant cost
of Police time as the operation was planned over a 6 month period and
involved almost 100 staff.
We wonder if you would be willing to make your request more specific which
will allow us to comply with it without delay and possible costs being
sought from you.
I would be willing to release a copy of the Operation Order with a few
redactions that remove information about Police tactics.
In regard to the Police photography there will be significant number of
photos and video that captures private individuals and would for privacy
reasons not be able to be released.
Also as there are a number of people charged and still facing criminal
proceedings much of the photographs and video may be required for
evidential purposes.
I would be happy to discuss further with you to enable us to meet your
request as soon as possible.

To clarify my request, I'm happy to limit my request to:
(a) a copy of the Operation Order, as you suggest;
(b) copies of all photos that meet the requirements in your FAQ at https://web.archive.org/web/201704160509... and a count of how many photographs don't meet those requirements and why; and
(c) copies of any materials released to any other party under the OIA covered by the scope in the original request.

Hello,
Is there an update on the Ombudsman investigation into withholding provisions being relied on?
I would be surprised that the withheld imagery could continue to be withheld per Section 9(2)(a), as the imagery would have been taken in publicly accessible areas.
The only imagery that could potentially be withheld would have been covertly captured, but this would be a Section 6 withholding provision.
I am contributing to an article on this subject matter, so would appreciate any update you may be able to provide.

The Ombudsman's reference is 467908. The last I've heard is on April 9 (with personal details removed):

I refer to previous correspondence regarding this complaint.
The Chief Ombudsman received a report from the Police regarding its decision on 23 January 2018.
Due to the nature of the work that your complaint requires, it has been transferred to our Investigations team, where it is now awaiting allocation to an investigator to progress through to conclusion.
While I cannot give you a precise date as to when your complaint will be allocated, as that will be determined by the complaint closure rate and where your complaint sits in the queue, as soon as your complaint is allocated, the investigator whom is responsible will contact you to advise you of the planned course of action.

It would be interesting to know whether all 166 photographs and 21 video clips of various length are included on the DVDs.
What was the Ombudsman's rationale for releasing or withholding any of the images and videos?

Notes:
Have received 3 DVDs from NZ Police with the photos and videos mentioned above.
The photos' EXIF data confirmed that they were sequential images from the same camera body with none missing from the sequence (except perhaps from the end, since there was no way of checking for that).
I have confirmed to the Ombudsman that I have received the the material and they have sent me the documentation confirming that they have closed the investigation (Case ID 467908).
