Kia ora,
I am making this request under the Official Information Act 1982.
I am seeking information held by the agency regarding its policies, practices, monitoring, governance, and records relating to employees undertaking work beyond their contracted hours, normal role requirements, or paid employment arrangements.
Unless otherwise stated, this request relates to the last five financial years.
Please provide the following information:
1. Policies, guidance and procedures
Copies of any policies, procedures, guidelines, standards, manuals, instructions, or other documents that address:
* overtime work;
* employees working beyond their contracted hours;
* additional duties outside an employee's normal role or position description;
* approval and recording of additional hours worked;
* time in lieu, overtime payments, allowances, or other forms of compensation for additional work;
* workload management where employees are regularly working beyond their contracted hours;
* manager responsibilities for monitoring or approving additional work.
Please also provide copies of any relevant internal communications or guidance issued to managers or staff on these topics.
2. Monitoring and oversight
Copies of any documents describing the systems, processes, controls, or reporting mechanisms used to identify or monitor employees working beyond their contracted hours or employment agreements.
This includes, where held:
* any requirements for managers to approve or record additional hours worked;
* any reporting provided to senior leadership, executives, Human Resources, or governance committees regarding additional hours worked;
* any documents identifying limitations, risks, or gaps in the organisation's ability to identify unpaid or unrecorded additional work.
3. Workforce information
If recorded, please provide information showing the number of employees who performed work outside their contracted hours during each of the last five financial years, broken down by:
* financial year;
* business unit or team (where available);
* whether the additional work was recorded as:
* paid overtime;
* unpaid work;
* time in lieu; or
* another recorded arrangement.
If this information is not held in this form, please provide any existing reports or summaries that contain comparable information.
4. Expenditure
Please provide records showing the total expenditure for each of the last five financial years on:
* overtime payments;
* allowances relating to additional duties or additional hours worked;
* time-in-lieu arrangements (where recorded);
* contractor or temporary staff engaged to manage workload pressures or staffing shortages.
5. Reviews, audits and staff feedback
Copies of any reports, reviews, audits, investigations, surveys, staff feedback summaries, or other documents relating to:
* excessive workloads;
* employees working beyond contracted hours;
* unpaid work expectations;
* workload-related health, safety, or wellbeing concerns;
* risks associated with employees routinely performing additional unpaid work.
6. Complaints and employment concerns
Copies of any reports, summaries, investigations, or records relating to complaints, concerns, grievances, protected disclosures, or internal reviews raised by employees regarding:
* being expected to work beyond contracted hours;
* performing duties outside their paid employment arrangements;
* unpaid work expectations;
* excessive workload.
Where personal information would otherwise prevent release, I am happy for documents to be provided with appropriate redactions.
7. Advice to leadership
Copies of any advice, briefings, memoranda, reports, or correspondence provided to senior leadership, Human Resources, executives, or governance bodies relating to:
* compliance with employment obligations concerning overtime, remuneration, or additional hours worked;
* the organisation's responsibilities for identifying and managing excessive workloads;
* legal, financial, operational, or health and safety risks associated with employees routinely working beyond their contracted hours without appropriate recognition or compensation.
8. Controls
Copies of documents describing the controls the organisation has in place to ensure employees are not routinely performing work beyond their contracted hours without appropriate:
* approval;
* recognition;
* remuneration;
* time in lieu; or
* workload adjustment.
9. Unidentified additional work
Copies of any reports, investigations, audits, reviews, or other records identifying instances where employees were found to have worked beyond their contracted hours or paid employment arrangements without the organisation being aware at the time the work was performed.
Where held, please include records identifying:
* the number of such instances;
* how they were identified;
* any actions taken in response.
If the agency does not hold information in the exact form requested, I request any existing documents, reports, summaries, or records that contain the relevant information.
If any part of this request is likely to be refused under section 18(f) of the Official Information Act 1982 because it would require substantial collation or research, I request that the agency first consult with me under section 18B to discuss whether the request can be refined or prioritised before a decision to refuse is made.
If any part of this request is refused, please identify the specific provision of the Official Information Act relied upon for each refusal and release all remaining information that can reasonably be made available.
