I would have assumed that MBIE would have been across this when the bonds were verifiably found never lodged to it as documented in the tenancy tribunal decisions.

I would have assumed that MBIE would have been across this when the bonds

I do not think they can rely on "privacy of natural persons" to wholly withhold. I've complained to Ombudsman.

I do not believe that you have grounds to withhold the document pursuant to 9(2)(a) of the Act, to protect the privacy of natural persons, including that of deceased natural persons.

a limited nor trust are not natural persons and the person is a public political figure with extensive public history surrounding these issues thus I've used it as an example.

I also wonder about any political considerations whether MBIE is not using it's enforcement regime given this and I would like to understand how MBIE is using it's statutory enforcement authority.

Keep in mind that Tenancy tribunal has made numerous decisions, explicitly referring to under public interest test regarding the situation of bonds.

Please provide the reasons why neither the public interest test does not apply.

I also need to mention that you should / if applicable / use point redactions pursuant to 9(2)(a) instead of attempt to withhold whole sets of information / documents.

I have also complained to Ombudsman but I invite you to submit the documents regardless.

Thank you for your follow up email.

 

Regarding the refusal under privacy, this pertains to the complainants’
privacy, not the company. You are correct that a company is not a natural
person. However, the complainants are potentially vulnerable individuals,
and releasing details of their complaints is plausibly identifiable to
them.

 

However, we have reviewed the information refused, and can provide this
further information:

 

o Ten complaints were made to the Tenancy Compliance and Investigations
team regarding Mighty Rocket Properties Ltd and Aaron Wayne Gilmore. 

o   Eight of these complaints were referred to our Service Centre
for additional information, and no investigation was required. 

o   Two of these complaints have been combined into a single case which is
currently under active investigation. As such we cannot release any
further information about this to you.

 

The themes of these complaints include bond lodgement and maintenance
issues. TCIT has also received complaints regarding the obligations
between property manager and property owner not being met; however, these
fall outside our jurisdiction and have been referred through to the proper
channels.
