Earlier in the year I had filed H2026077293 which was decided upon and refused late last week.

As such, I'd like to request a copy of any documents and correspondence that were generated in order to decide upon H2026077293.

I would also like to request a copy of any documents and correspondence that were generated in order to perform the public interest test in regards to Section 9(2)(b)(ii) specifically.

Thank you for your follow up request regarding the response we provided to
your request under the reference number H2026077293. 

 

The general approach to responding to your request, and other similar
requests made under the Act around that time, was developed through
in‑person discussions. Therefore, there are no specific documents that
note this. The internal correspondence that does exist was generated
through our standard internal review process of all requests made under
the Act, of which is administrative in nature. As such, there is no
substantive information within that details decision making. Additionally,
legal advice received with respect to the general approach the
Ministry has taken in responding to ManageMyHealth-related requests is
withheld in full under section 9(2)(h) of the Act,
to maintain professional legal privilege. 

 

The decision to use section 9(2)(b)(ii) of the Act, and the reasoning for
applying this specific section is due to ManageMyHealth, the primary party
in the information you have requested, being a private company. Release of
the requested information (which included some information provided by
ManageMyHealth) would likely unreasonably prejudice the commercial
position of their organisation. The public interest was considered in
conjunction with the each of other grounds applied, not just section
9(2)(b)(ii). At this stage, we have deemed the public interest in
releasing the information to not outweigh the need to withhold. 

 

Under section 28(3) of the Act, you have the right to ask the Ombudsman to
