Thank you for your request under the Official Information Act 1982 (the
Act) on 30 August 2021 for:
“Have any COVID19 vaccine manufacturers been provided with liability
waivers of any kind, including negligence by the NZ government or any
agency?
Please provide details of any such waivers and the companies and agencies
involved”
I have been advised that indemnities have been granted to Pfizer,
AstraZeneca, Janssen and Novavax for their COVID-19 vaccines. Indemnities
have also been granted for the donation of the AstraZeneca vaccine to the
COVAX Advance Market Commitment (COVAX AMC), and for the donation of the
Pfizer vaccine to Polynesia.
I have been advised that the Ministry of Business, Innovation and
Employment (MBIE) have previously released information related to the
indemnities granted to Pfizer, AstraZeneca, Janssen and Novavax for their
COVID-19 vaccines. For this reason, I have decided to transfer your
request to MBIE under section 14(b)(ii) of the Act. You can expect a
response from MBIE regarding this information in due course.
I have also been advised that information on the indemnities granted for
donating vaccines to COVAX AMC and Polynesia is more closely connected to
the functions of the Treasury. For this reason, I have also decided to
transfer your request to the Treasury under section 14(b)(ii) of the Act.
You can expect a response from the Treasury regarding this information in
due course.
My apologies for the late transfer of your request.
