Building Code Performance Clause C5.2

Dear Ministry of Business, Innovation & Employment,

Performance Clause C5.2 states the following:

Buildings must be designed and constructed so that there is a low probability of illness or injury to firefighters or other emergency services personnel during rescue and firefighting operations.

Please provide a copy of all New Zealand Fire Service (NZFS) operational documents (i.e. Standard Operating Procedures, Training Manuals/Procedures and Size-up Procedures, Controlled Entry and Safety Procedures etc) provided by the NZFS Commission to the Ministry of Business, Employment and Innovation (MBIE), that MBIE relied upon to justify Performance Clause C5.2 being included in the Building Code.

Did MBIE rely on a research report undertaken independently of the NZFS and MBIE that correlates the injuries incurred by NZFS firefighters to building design.and construction and not to deficiencies in operational procedures, operational errors, training methods etc adopted by the NZFS, to justify Performance Clause C5.2's inclusion in the Building Code? If so, please provide a copy of this report.

If MBIE did not use such information to determine the suitability of Performance Clause C5.2 being included in the Building Code, please confirm this.

Dear Ms Evans,

 

I refer to your requests to the Ministry of Business, Innovation and
Employment (MBIE) on 11, 12 and 13 November 2015 for information
concerning performance clauses C5.2, C5.4, C5.6 and C5.7 of the building
code.  Your requests were made via FYI.ORG.NZ.  MBIE transferred your
requests to the New Zealand Fire Service (NZFS) under section 14 of the
Official Information Act 1982 (Act) on 23 November 2015.

 

NZFS personnel have subsequently carried out an extensive review of the
NZFS’s records (including electronic records) to determine whether it
holds the information referred to in your requests.  To date, we have been
unable to locate information about what was provided to MBIE (or its
predecessor agencies) during the development of the current clauses of the
building code.  It is possible that independent examination of the NZFS’s
electronic ‘back up’ records may locate some relevant documents, but this
would be an expensive exercise that would not necessarily be successful.

 

In the circumstances, your requests for information may need to be
declined under section 18(e) of the Act, on the basis that the documents
you have requested do not exist or, despite reasonable efforts to locate
them, cannot be found.

 

However, before the NZFS makes any decision in that regard, I invite your
comments on the following options that may enable your requests to be
granted:

 

1.       Would you be happy for the NZFS to liaise with MBIE to see if
MBIE has any documents relevant to your requests?  This may enable the
NZFS to identify any relevant policy documents (etc) that were provided to
MBIE during the building code review process.  Consultation with MBIE
would extend the time required to respond to your requests beyond the
period provided for in the Act.  However, it may be that a revised
timeframe can be arranged by agreement.

 

2.       Alternatively, would you be happy for the NZFS to provide its
current documents that relate to the various categories of information you
have requested?  The qualification to this option is that there would be
no information about whether any of the documents (or earlier versions of
them) were definitely provided to MBIE during the building code review
process.

 

Aside from these options, it may be that you are able to refine your
requests in some other way that would enable the identification and
release of information.  Please let me know if you have any suggestions in
that regard.
