Dear KiwiRail,
Council engaged with your property team earlier this year to request the transfer of a small area of land administered by Kiwi Rail and currently leased by Council at 36 Station Rd Te Puke for solid waster purpose under s50 of the Public Works Act 1981. Council currently leases the land which adjoins the former Kiwi rail land now owned by Council.
Part way through the process after Kiwi Rail had incurred fees payable by Council as part of the disposal project Kiwi rail stopped the process quoting it was to be held for strategic purposes. Based on the small size and location Kiwi Rail or no other party except council could do anything with the land.
Council request information on what are the protocols required by Kiwi Rail when considering disposal of land and what the future strategic requirement for the land is except of course gaining rental from Council
