Dear New Zealand Police,
I am writing to formally request information under the Official Information Act regarding the impoundment of a motorbike, a 2009 Harley Davidson VRS with the number plate C5PRY, which was impounded for a period of six months.
Specifically, I would like to request the following information:
1. **Details on Six-Month Impoundments**: Information on the policies and procedures surrounding six-month impoundments of vehicles, including the legal grounds for disposal before the end of the impoundment period.
2. **Tow Yard Disposal Legality**: Clarification on whether the tow yard, GHL Salvage and Recovery located at 64 Luke Street, Otahuhu, was legally able to dispose of the motorbike prior to the end of the impoundment period, especially in light of the fact that payments were made towards the impoundment fees, including a payment arrangement to be made in full for the remainder amount and accepted by the tow yard. And the allowance of a New Zealand Police contracted Tow Yard performing in-house misconduct on how many other impounded vehicles.
3. **Disposal Notice**: Information regarding whether a police officer signed the disposal notice for the motorbike and the legal implications of this action.
4. **Notification Requirements**: An explanation of the legal requirements for notifying individuals regarding the disposal of their vehicles. This was never sent or advised by the New Zealand Police regarding the motorbike to the registered owner. There are no details available regarding the officer who impounded the motorbike or the officer who signed off on the disposal at the tow yard.
Additionally, please note that the motorbike was pulled over on the Northwestern Motorway just before the Newton Road turn-off on June 22, 2024, between 5:00 PM and 7:00 PM.
One further request is who is responsible for the illegal disposal of this Motorbike as it seems that GHL or the Police Officer who signed the disposal notice have violated the 6 month impoundment Laws section 96AAA of the NZ Transport Act 1988, Also subsection 3AAA(b) and breached section 96(6) and section 113 of the Land Transport Act 1988.
