Dear Christchurch Boys' High School,

this is an Official Information Act request.

I would like copies of all evidence provided to  district court judge
Robert Murfitt in the course of their investigation or any information
gathered by said judge.

I would like a copy of the interview transcript with the student involved
in the alleged assault by the headmaster Nic Hill.

I would like a copy of the footage of the alleged assault, I am happy for
this to be censored to protect the identities of the student.

I would also like all copies of board minutes relating to this matter.

If any of this information is not provided under the advice of legal
counsel, I would like the specific supporting sections of legalisation in
the reply so I can easily forward it to the ombudsman.

With regard to your request. CBHS advises there was categorically not an
assault as you suggest. The Board received an expression of concern back
in 2021 in relation to an incident. That notification did not come from
any parties involved in the incident or their parents.  A retired Judge
with deep experience of working with children was engaged. This was an
appropriate step and he was in full control of that process. He viewed the
footage, interviewed a student, the boy’s parents and Mr Hill. He was open
to interview any other witness if he saw the need. He reported the student
was very clear Mr Hill’s actions were in the nature of a light-hearted
exchange. The boy’s parents saw the incident as trivial and the expression
of concern as both regrettable and unfounded.

 

The outcome was that Mr Hill was deemed to have done nothing inappropriate
in this exchange with a student which was described by the investigator as
non-verbal encouragement of good behaviour.

 

The retired Judge noted the Board might be troubled by the manner in which
school CCTV footage has been accessed and used, which he considered might
be unlawful.

 

Your request seeks personal information in relation to Mr Hill who is an
employee of CBHS. As with all CBHS employees, we will not discuss specific
aspects of his employment or provide his personal information, except as
summarised above. Your request is refused under Section 9(2)(a) of the OIA
as the withholding of that information is necessary to protect the privacy
of Mr Hill as well as the CBHS student involved. That is not outweighed by
other considerations which might render it desirable, in the public
interest, to make that information available, nor are redactions or
partial disclosure of information possible given the nature of the
information sought.

 

You have the right to seek an investigation and review by the Ombudsman of
