Extension of statutory due date
3. Unfortunately, it will not be possible for Council officers to meet
the time limit for responding to your request by 11 June 2024 and we are,
therefore, writing to notify you of an extension of the time to make our
decision, to 9 July 2024.
This time extension is required in order to allow Council officers
sufficient time to search through a large quantity of information in order
to make a decision on your request in accordance with section 14(1)(a) of
the Local Government Official Information and Meetings Act.
We had previously sought clarification from you on your request (as
detailed below). If you are able to provide clarification, it will assist
us in responding to your request.
4. If you are not satisfied with what has been communicated to you in

1. Further to your request for information, dated 13 May 2024,
regarding Consent numbers, Napier City Council is pleased to provide you
with its response.
2. Your request:
a. Could you please supply the number of consents issued since the Tonkin
and Taylor report was received that relate to properties that have
been designated in the 1 and 2% AEP Zones,
b. and the date that the report was received by council and when it
started to be taken into account when considering consent
applications.
c. Could you please provide any relevant communications that helped
shaped council policy regarding consents on affected properties as a
result of the T+T report.
3. Council’s response:
a) There have been 53 building consents and 17 resource consents
issued since the Tonkin + Taylor report was received on 29 November 2023,
which relate to the properties in the 1% and 2% AEP zones.
b) Council received the report on 29 November 2023 and began taking
the report into account when processing applications from 14 December
2023.
c) Council does not hold any relevant communications that helped shape
Council policy regarding consents on affected properties as a result of
the Tonkin + Taylor report. Consequently part c) of your request is
refused under section 17(e) of the Local Government Official Information
and Meetings Act 1987 – that the document containing the information that
the document containing information requested does not exist.

Extension of statutory due date
3. Unfortunately, it will not be possible for Council officers to meet
the time limit for responding to your request by 11 June 2024 and we are,
therefore, writing to notify you of an extension of the time to make our
decision, to 9 July 2024.
This time extension is required in order to allow Council officers
sufficient time to search through a large quantity of information in order
to make a decision on your request in accordance with section 14(1)(a) of
the Local Government Official Information and Meetings Act.
We had previously sought clarification from you on your request (as
detailed below). If you are able to provide clarification, it will assist
us in responding to your request.
4. If you are not satisfied with what has been communicated to you in
this email, you have the option to contact the Office of the Ombudsman to
request a review.
