Police Infringement notice

Abdullah made this Official Information request to New Zealand Police

This request has been reported as needing administrator attention (perhaps because it is vexatious, or a request for personal information)

From: Abdullah

Dear New Zealand Police,

I hope this message finds you well. I am writing to seek clarification and resolution concerning an incident that reportedly occurred during my recent visit to South Island.

On January 31 2024, I received a phone call from an unidentified number (021 1915320), which I was unable to answer at the time. Subsequently, I received a text message purporting to be from the Police. Given the prevalence of spam calls requesting personal information, I initially dismissed this as such. However, upon receiving another call from the same number, the caller requested my car and personal information under the premise of a police inquiry. Despite my reservations, I ultimately provided my name and address. The caller then informed me of an infringement number and alleged that I was involved in a case related to unsafe passing.

Confused and concerned, I contacted the NZ Police helpline to verify these claims, only to be informed that there was a record of a traffic stop and ticket issued in my name for unsafe passing—a violation I am certain did not occur. At no point during my visit was my vehicle stopped by a police officer, nor have I engaged in the behaviour alleged.

I firmly believe in adhering to the road rules, including those regarding safe passing, as outlined by the NZ Transport Agency (https://www.nzta.govt.nz/roadcode/code-f...). Therefore, the claim of my involvement in such an incident is both surprising. I have also sent an email but the response time is 20 days and I am not willing to pay if there's any amount to pay and any date range. The call centre mentioned that the ticket letter went to my previous address where I lived 5 years ago which also I never provided during the phone call.

In light of the above, I respectfully request a thorough investigation into this matter to rectify any inaccuracies and clear my record of the alleged infringement. I am committed to cooperating fully with any inquiries you may have and am hopeful for a swift resolution.

Yours faithfully,
Abdullah Al Asif

Dear Ministerial Services,

On January 31 2024, I received a phone call from an unidentified number (021 1915320), which I was unable to answer at the time. Subsequently, I received a text message purporting to be from the Police. Given the prevalence of spam calls requesting personal information, I initially dismissed this as such. Despite my reservations, I ultimately provided my name and address. The caller then informed me of an infringement number and alleged that I was involved in a case related to unsafe passing. I also provided my present address yet the letter was sent to a very old address and caused a delay to raise this question here or to make the payment.

Can I please get an answer to my original questions here?

1. I firmly believe in adhering to the road rules, including those regarding safe passing, as outlined by the NZ Transport Agency website(https://www.nzta.govt.nz/roadcode/code-f...). Therefore, the claim of my involvement in such an incident is both surprising.
2. What was the speed of the vehicle that recorded my car passing? I have received the video that showed the vehicle which recorded my card was more than 50km speed limit. And that car was releasing very black smoke that I needed to safely pass.
3. What notices were sent to the other vehicle owner for going over the speed limit?

Please reply to me on this page instead of my personal email address.

Yours sincerely,

Abdullah

Dear Ministerial Services,

It seems like intentional mental harassment to me by making it delayed as I received a call last week Friday to confirm my address which I did.

Yet, I have not received the letter to review it.

I am still waiting for the answers to my above queries.

Yours sincerely,

Abdullah

Dear Ministerial Services,

1. I have not received a response on this page yet and today is March 21.

2. I still have not received the notice letter to my physical address. I believe this is being sent to the wrong address intentionally even after I received letters before that to the present address.

3. This is mental harassment and pushing me to pay on the due date without sending me the letter when I couldn't review the notice. Isn't it a mental harassment?

4. They keep ignoring my questions. Here's the video where I can see the person who recorded was speeding - https://nzpolice-my.sharepoint.com/perso...

Yours sincerely,

Abdullah

Kia ora Abdullah,

Thank you for your email.

Your request is not being considered under the OIA, as it is not the appropriate channel to challenge an infringement notice.

Please be advised that your case has already been reviewed and addressed by the adjudication team lead in which Police's position has been made clear. If you wish to challenge the validity of the evidence or the circumstances surrounding the alleged offence, you may wish to request a court hearing: https://www.police.govt.nz/advice-servic....

Alternatively, if you are unsure how to proceed, please reach out to a lawyer or approach one of the twenty-four Community Law Centres situated throughout New Zealand: https://communitylaw.org.nz/.

As it stands, the infringement remains payable by the final due date.

Dear Ministerial Services,

Thank you for your response.

1. I still don't have the letter and without a letter to my correct address I am unable to know the exact reason for this notice and I am unable to know the due date. Without clear information and proof, I am unable to pay.

2. I still do not have the answer for the person who recorded the video. I have raised a complaint to investigate this as that person was over the speed limit. What action was taken for the other person? If none, I would like to file one.

3. I would also like to know where I can see that can't pass in the work area as I cannot find that information on the NZTA website.

I strongly believe I have a valid reason to know all the above information before accepting my fault and paying the fine. I also strongly believe the Police intentionally sent a letter to the wrong address to delay the payment. Note: As of today 1:26 PM I haven't received the letter and the proof.

Yours sincerely,

Abdullah

Kia ora Abdullah,

You could go back with something along the lines of:

As per your discussions with the Adjudication team lead, Police has addressed your case in full and will not respond to any further correspondence regarding this notice.

Although you may disagree with PIBs assessment, you have the right to request a court hearing in which a district court judge will facilitate the final decision in accordance with New Zealand law. This will give you the opportunity to present your case under oath and contest the validity of Police’s evidence and vice versa. It should be stressed that this process does not favour one party and relies upon the neutrality of the court to ensure a fair a just proceeding.

Dear Ministerial Services,

I am still waiting for the proof and I haven't received the video to watch it to make sure I did that. I am requesting you send me the video via email or Google Drive. I strongly believe that you are delaying that intentionally to harass me by setting a deadline to pay the fee. I am now mentally harassed as I had to reach out to you several times which is not good for mental health.

Yours sincerely,

Abdullah

Dear Ministerial Services,

I am still waiting for the video link like how Ross Young shared the file with me but later I was unable to open the file. I have the right to request proof to see if I need to pay the fine. I believe the Police are intentionally harassing me now regarding this matter. I am feeling very low mentally due to this. This is affecting my daily life as I kept thinking about this huge amount of fine.

How soon can I expect the video to be shared again with my email?

Yours sincerely,

Abdullah
