Pastoral Statistics

Mr Joe (Account suspended) made this Official Information request to Otumoetai College

Response to this request is long overdue. By law Otumoetai College should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: Mr Joe (Account suspended)

Dear Otumoetai College,

I am writing to formally request the following information under the provisions of the Official Information Act (OIA):

A tabulated breakdown of incident types, categorised by student year level, for the year 2023 to date, as well as for the following years:
- 2019
- 2020
- 2021
- 2022
A tabulated breakdown of incident types, categorised by school house, for the year 2023 to date, as well as for the following years:
- 2019
- 2020
- 2021
- 2022

Please segregate the data by each individual year.

This data can be readily accessed through your Kamar software under the "Reporting > Statistics > Pastoral" section. As specified: https://www.kamar.nz/reporting/statistic...

Your prompt attention to this request is greatly appreciated. I look forward to your timely response.

Please CONFIRM receipt of this email to prevent unnecessary follow-up emails and extensions being requested.
------------------------------------------------------------------------------------------------------------------
As required by s12(1) of the Act, I am a New Zealand citizen. I will provide confirmation of this, if required. However, since all of our correspondence will be published on the FYI.org.nz site, I will only do so over the phone or email, with which you provide. This would only be for the purpose of citizenship confirmation, and nothing further related to this request.

As required by s13(c) of the Act, if this request “has not been made … to the appropriate department or Minister of the Crown or organisation or local authority”, it is your duty to give reasonable assistance to me to direct my request to the appropriate department or Minister of the Crown or organisation or local authority.

Further to the above statutory requirement, under s14 of the Act, if the information I seek is either not held or you believe it is more closely connected with another department or Minister of the Crown or organisation, or of a local authority you shall promptly, and in any case not later than 10 working days after the day on which the request is received, transfer the request to the other department or Minister of the Crown or organisation, or to that local authority, AND inform me accordingly.

As required under s15A of the Act, if you believe that a time extension is warranted for this request, you must under ss15A(2),(3) and (4) give notice to me of this extension within 20 working days after the day on which my request was received. In that notice, you should state; the period of the extension, give reasons for the extension and remind me of my right to complain to the Ombudsman under s28(3). Finally, the extension must be for a reasonable time, having regards to the circumstances.

As required by s18B of the Act, you must consider consulting me before refusing my request under the provisions of ss18(e) and (f) which relate to a document not being able to be found or existing or where substantial collation and research would be required for my current request.

As required by s19(a)(i), you must provide reasons if you refuse any parts of this request.

I will, if required, complain to the Ombudsman, as is my right under s28(3) of the Act, if any of the above statutory requirements on you are not complied with. Further to this, if your reply is not “as soon as reasonably practicable, and in any case not later than 20 working days after the day on which the request is received” as required under s15(1) of the Act, I will also complain to the Ombudsman.

This request is made through the site FYI.org.nz. All correspondence will be automatically forwarded to me through the site and published online immediately. I require, where appropriate, all electronic copies of all documents in your response. For more information on how the site works, please visit www.fyi.org.nz/help/about.

Yours faithfully,

Mr Joe

Kia ora Mr Joe
We have received your request and require more information please under
section 12, subsection 2.
Firstly could you please provide proof that you are a New Zealand citizen.
Secondly, your question is quite broad and we need greater understanding
as to what exactly you want to know in regards to 'incidents'.  Could you
give further clarification please.
Ngā mihi
Viv

Dear Principal's PA,

Thank you for your response.
I believe you use Kamar, as you list the Kamar portal on your website. If this is incorrect please advise me.

The 'incident types' I am seeking are:
- Attendance
- Classroom
- Discipline
- Guidance
- Uniform

These categories are standard for all users of Kamar, unless custom modifications have been made.

I can confirm I am eligible to make a request under the OIA. However if you insist that I demonstrate my eligibility to make a request, provided you confirm this request is likely possible on your initial evaluation. I could provide you with a New Zealand document under my name officially apostilled by the Department of Internal Affairs' Authentication Unit. I can send a copy via letter post or facsimile. Please note the due date is not affected by the processing of this.

Alternatively, the Office of the Ombudsman can confirm eligibility for you.

Yours sincerely,

Mr Joe

Dear Principal's PA,

I acknowledge your correspondence. I wish to inform you that I have promptly dispatched a copy of my driver's license to the designated address. I assure that upon receiving you will be utterly disappointed.

In alignment with the Ombudsman's perspective, scrutinising the eligibility of the requester to make requests does not warrant an extension of the specified timeframe, as elucidated in their guides (refer to https://www.ombudsman.parliament.nz/site...). Furthermore, considering the imminent holidays, the original due date remains on Tuesday, January 16, 2024—sufficient time for due process, even amidst potential postal delays.

I must draw your attention to that under the OIA that clarifications must be sought within a concise 7 working days. A delay exceeding this timeframe in the verification process, followed by a subsequent realisation of the need for clarification, leaves one devoid of legal grounds for such action, especially given the ample time available for due diligence.

It is my view that individuals lacking eligibility for such requests are unlikely to manifest interest in establishments like Otumoetai College or any other secondary school in New Zealand. Notably, even agencies such as the Government Communications Security Bureau rarely engage in inquiries into the eligibility of requesters.

Regarding your inquiry into the intended use of the requested information, it is imperative to recognize that I am under no obligation to furnish such details. In response to your question, I shall neither confirm nor deny the existence or nonexistence of any possibilities or facts pertinent to your inquiry.

Yours sincerely,

Mr Joe

Dear Mr Joe
We acknowledge receipt of your drivers licence, however, in order to prove
that you are a NZ citizen we require either a copy of your birth
certificate or a NZ passport.
On receipt of either of these two documents confirming you are a NZ
citizen, we will provide you with the information as requested.
Sincerely
Viv
