Dear Kerikeri High School,

I would like to request the following information under the Official Information Act 1982:
I would prefer to receive an electronic response. Queries about this request will be automatically forwarded to me by the fyi.org.nz website.
With regards to s12 of the OIA, I am an NZ citizen, and in NZ.

1. Please confirm KKHS CCTV was compliant with ALL guidelines set by the Privacy Commissioner from 1/1/22 to 12/9/23

2. Are all KKHS Policies independently checked by a Legal team and regularly audited to ensure they follow NZ Law, Human Rights and the NZ Bill of rights, Mana Mokopuna and the Childrens Convention.

Surrender and Retention of Personal Digital Devices
- Grounds for surrender and retention of personal digital devices
In the case of disruption of the learning environment, teachers and authorized staff can ask the student to show them the digital item (e.g. a photos, emails, texts, social media posts, audio and video clips) and/or delete it.

Searches of digital devices KKHS Policy
-Staff cannot ask students to download or reveal an item on another digital device, a social media site, or storage system. Staff cannot search the device contents or online accounts, or ask for the password for the device.

Staff cannot search a device. The police have the ability and authority to search a digital device and must be contacted if a search is deemed necessary.

21. Unreasonable search and seizure
Everyone has the right to be secure against unreasonable search or seizure, whether of the person, property, or correspondence or otherwise.

3, Are students informed of their rights before KKHS Staff seize student property and search through their correspondence? Are they informed and understand these rights before being “ASKED” to hand over their personal property for search and seizure

*KKHS Policy*
A search is not mandatory. Kerikeri High School may manage the issue through the behaviour management strategies including stand-downs and suspensions.

We can search school–owned digital devices. We consider student privacy when searching a school device.

4, What steps if any do KKHS Take to ensure that all students ages 11-17 (Minors and Young Adults) are aware of School policies and procedures and their rights in regards to these policies. Please list your Authorized teaching Staff and Non Teaching staff (List is not Publicly available in your Policy Docs)
