Dear Office of the Ombudsman,

I have recently had your office tell me that you will not investigate my complaint because the department I asked for official information had likely deleted my request, considering it spam, though it was to the correct address and had in the subject line "Official information act request"

I understand that you are not subject to the OIA, but I was hoping you could tell me how many complaints in the 12 months to 31 August 2023 your office has refused to investigate a complaint because the government department involved had no record of the request for information.

I refer to your information request on behalf of the Chief Ombudsman. The
Ombudsman does not record information about complaints closed ‘because the
department involved had no record of the request for information’. The
basis upon which the Ombudsman closes complaints may be seen in chapter 7
of the Ombudsman’s annual reports, available here:

The Ombudsman generally is under strict statutory secrecy and privacy
obligations with respect to investigative information held by him, subject
to certain statutory exceptions which are not applicable here.
Consequently, I have sent further information to your email address rather
