Cannot work because Green List Straight To Residence Visa Pending

Aswin Shobhan made this Official Information request to Ministry of Business, Innovation & Employment

Response to this request is long overdue. By law Ministry of Business, Innovation & Employment should have responded by now (details and exceptions). The requester can complain to the Ombudsman.

From: Aswin Shobhan

Dear Ministry of Business, Innovation & Employment,

My name is Aswin Shobhan.
Application number: A2937576
File number: 70051626

On Nov 4th 2022, I had applied for Green List Straight To Residence Visa and I have been waiting for the outcome since then.

On 12th Feb 2023 my post study work visa expired and I was granted an interim visa as a result of an application for a visitor visa to stay here, in hopes INZ may process my visa in time.

Today is 6th of April 2023, it has been almost two months since I have been able to work and I am currently living off my savings. It took immense hard work; actual material hours of work, to get a job as an Electrical Engineer almost 3 years after my graduation. Even though my company had the kind heart to maintain my position, it is only sensible to assume that I could be at risk of losing my job if this condition prolongs.

To further add to my pathetic condition, a lot of people some of whom I personally know and some of whose experiences are being shared on related Facebook groups, who had applied under the same category of straight to residency visa MUCH LATER than I have, have got their visa within a matter of weeks and in one case mere days. Comparing myself to those close to me who have got their visa, I see no difference between me and them in any particular way.

INZ says that they cannot escalate the process because the concerned third party have their own schedule, but if I can call the INZ, a third party to me, every week on the status of the visa, why can't my case not be escalated, considering that I am deprived of being able to generate any income for sustenance, to the concerned party at least on a humanitarian basis?

I hope that I may get some fair answer on the question of my condition.

Yours faithfully,

Aswin Shobhan
