I am in receipt of your three LGOIMA requests.
Firstly – can we please combine the response to the requests given the
subject matter overlaps? Can you confirm that we can use the email
[1][FOI #22162 email] as the point of contact?
Secondly – I am seeking clarification on some of the matters below. Can
you please advise?
OIA 2023-056:
Please provide copies of any consents or documents relating to consents
for the dumping of cleanfill or other materials at 1044 Coast Road
Wainuiomata [Lot 5 DP 551868].
We do not have any consents for the activities listed above. We will
confirm this in our response.
Please provide any consent related documentation relating to the dumping
of material within the stream bead at approximate location 1,759,492.339
5,420,614.389 Meters.
We do not have any consents for the activities listed above. We will
confirm this in our response.
OIA 2023-057: Could you please clarify what involvement the GWRC has with
consents or monitoring of the dumping of material at 1044 Coast Road
Wainuiomata.
As per above this activity has not been consented, however we are aware of
recent earthworks on the property and have provided advice in relation to
this. Are you seeking a copy of this advice?
Does GWRC consider the dumping of fill into an apparently currently dry
riverbed (a historical part of the meandering Wainuiomata River) to be
turf farming or mineral extraction?
This is not a request for information held by GWRC. We can provide
further advice in relation to the rules of the proposed Natural Resources
Plan. Can you confirm this is what you are seeking?
OIA 2023-058: Hutt City Council advises that there is a consent relating
to Wainuiomata Stream relevant to my request. I am surprised to see this
as the request was for information relating to a point approximately 10
kilometres to the south-west of Wainuiomata Stream (aka Wainuiomata-iti
Stream). Please confirm if this is correct.
There are a number of consents granted (and many expired) for 1044 Coast
Road including works to the streambed (gravel extraction). I note it is a
large property. None of them relate to clean filling or dumped material in
a stream bed though. Is there anything else you require in relation to
this request?
Happy to discuss further via phone if this is easier.

Kia ora Joseph,
I will respond to each point in turn with text preceded by an '*'. Firstly, by way of explanation, I am the chair of the Wainuiomata Rural Community Association Inc. The requests were prompted by members complaining about vehicle traffic and concerns about the possible effects of dumping of material for people downstream. The context is the long running concerns that residents had with the recently closed cleanfill on the old treatment plant. The answers that I am looking for relate exclusively to current consents and are limited to the above concerns (with the one additional concern of environmental effects).

I am in receipt of your three LGOIMA requests.
Firstly – can we please combine the response to the requests given the
subject matter overlaps? Can you confirm that we can use the email
[1][FOI #22162 email] as the point of contact?
*Yes, you are welcome to combine the responses. Yes, I would prefer that the email reply is sent to the FYI website as this will result in a complete record which is accessible to members.
*Yes, that is sufficient for our purpose.
Please provide any consent related documentation relating to the dumping
of material within the stream bead at approximate location 1,759,492.339
5,420,614.389 Meters.
We do not have any consents for the activities listed above. We will
confirm this in our response.
*Yes, that is sufficient for our purpose.
*Yes, that is sufficient for our purpose.
*I am keen to know what sort of activity would be considered to be a matter for GWRC. I gather that GWRC is concerned with the bed of the Wainuiomata River, but I am unclear as to how this might apply to a river that clearly is subject to meandering. If this is a matter relating to the Proposed Natural Resources Plan I would be keen to know.
OIA 2023-058: Hutt City Council advises that there is a consent relating
to Wainuiomata Stream relevant to my request. I am surprised to see this
as the request was for information relating to a point approximately 10

large property. None of them relate to clean filling or dumped material in
a stream bed though. Is there anything else you require in relation to
this request?
*My understanding is that the issue may relate to a schedule. Am I right in believing that Wainuiomata Stream is a scheduled tributary to Wainuiomata River? As such I am confused as to the reply of Hutt City Council as the stream in question is in a distant location. I am only interested in current consents and only within the land at 1044 Coast Road.
Happy to discuss further via phone if this is easier.
* Thank you, but I would prefer that the communication is accessible to members.
Ngâ mihi,
Craig Innes

Kia ora Craig,
Thanks for your clarification on these matters.
- I will provide you with a list of active consents for 1044 Coast Road.
- I will provide advice on deposition of material within the bed of a meandering river. We can also provide further advice in relation to the rules of the proposed Natural Resources
- I will also provide you with a copy of the advice we gave to 1044 Coast Road regarding recent earthworks on the property.
I will complete the formal response next week.
