I am writing to request all of the following information held by the university relating to semester 1 2022 Faculty of Law courses. Please break the responses down by course:
- the number of students enrolled in each paper in semester 1 of 2022
- the number of students investigated for academic misconduct in each paper
- the nature of the alleged misconduct (e.g. whether it was in the exam or in coursework etc)
- whether this misconduct delayed the marking or administration of the paper it was concerned with
- the status of the investigation (ongoing or completed)
- the outcome of the investigations (misconduct or not)
- any penalty imposed following the investigations
- the number of students where it was their first investigation for academic misconduct

Dear Elliott,
I refer to your request of 20 September 2022. As consultations necessary
to make a decision on your request are such that a response cannot
reasonably be given within the original time limit, the University has
extended the time limit for your request until 8 November 2022 under
section 15A(1)(b) of the OIA. This is the new maximum time limit for the
University’s response; we will respond to your request as soon as
reasonably practicable. You have the right to make a complaint to an
Ombudsman if you are dissatisfied with this extension.

follows:
“I am writing to request all of the following information held by the
university relating to semester 1 2022 Faculty of Law courses. Please
break the responses down by course:
- the number of students enrolled in each paper in semester 1 of 2022
- the number of students investigated for academic misconduct in each
paper
- the nature of the alleged misconduct (e.g. whether it was in the exam or
in coursework etc)
- whether this misconduct delayed the marking or administration of the
paper it was concerned with
- the status of the investigation (ongoing or completed)
- the outcome of the investigations (misconduct or not)
- any penalty imposed following the investigations
- the number of students where it was their first investigation for
academic misconduct”
The University’s database for S1 2022 academic misconduct incidents does
not record the following data:
· Investigations for minor academic misconduct in
coursework/tests/research that did not result in a finding of academic
misconduct.
· Whether a particular incident is a student’s “first investigation
for academic misconduct”.
· Whether or not a particular incident “delayed the marking or
administration of the paper it was concerned with”.
· Ongoing investigations for academic misconduct.
See attached a spreadsheet with the information requested that is held on
the University’s Register of Academic Misconduct (as imported to the
University’s new Academic Integrity Management System), with the exception
of penalty breakdowns for courses with low numbers of confirmed academic
misconduct cases – that information has been withheld to protect the
privacy of those students under section 9(2)(a) of the OIA. There are no
ongoing investigations for academic misconduct in examinations for S1 2022
courses. All misconduct incidents set out in the attached have completed
investigations.
The information requested that was not held on the University’s Register
of Academic Misconduct cannot be provided without the University either
creating it (which the OIA does not require us to do) or undertaking
substantial collation or research. These parts of your request are refused
under section 18(f) of the OIA. As this is due to the nature of the
University’s database for academic misconduct incidents, neither extending
the time limit for the University’s response, imposing a charge, or
consulting you could allow this information to be provided.
The University will provide you with the information requested about the
number of students enrolled in semester 1 2022 Faculty of Law courses.
Please clarify whether this request is for every semester 1 2022 Faculty
of Law course, or just those with academic misconduct
investigations/incidents for Semester 1 2022 as included in the attached
spreadsheet. We will provide you with this information as soon as
reasonably practicable after you clarify this part of your request.
You have the right to make a complaint to an Ombudsman if you are
dissatisfied with this response.
