Rating Units are created and defined in accordance with the provisions of
the Rating Valuations Act 1998 (RVA). Sections 5B and 5C of the RVA set
out the statutory criteria for what constitutes a rating unit and gives
the Valuer-General the power to write more detailed Rules in certain
circumstances. Under S5B, where there is a certificate title then the land
within that title will be a rating unit unless it meets certain exceptions
whereby 2 or more certificate of title may constitute one rating unit; or,
part of a certificate of title may constitute one rating unit. Under S5C,
where there is no certificate of title there are similar Rule making
provisions for when 2 or more pieces of land or part of a piece of land
constitutes a rating unit.

 

These exceptions are prescribed in Rule 2.4 of the Rating Valuations Rules
2008, which are available on line.

 

If you believe that a rating unit(s) may not be correctly constituted then
this should be advised to your Council and their valuation service
provider to review.
