I refer to your question below.

 

The Council is not anti-protest and the protests in relation to Covid-19
mandates are no exception. The ability of citizens to protest their views
in a peaceful and respectful manner is a central tenet of democracy and we
uphold this unreservedly.

 

However, it is in everyone’s interests that protests are conducted safely.
Events that impact on the flow of traffic must be managed carefully
through a rigorous process that requires a Traffic Management Plan to be
put in place to mitigate possible risk. Without this there is a greater
likelihood that someone may be harmed. As you know the Council has a duty
of care to ensure traffic is managed during such events. We have reached
out to the organisers of these events to ensure any protest is managed
accordingly, but to date the organisers have not engaged with us about
providing safety undertakings.

 

We have not and do not charge fees for protests but do work with all event
organisers to ensure traffic safety is considered and actively included in
any activity using roads. The decision to invoice the protest event
organisers for the cost of traffic management was a decision we did not
take lightly but in fairness, all traffic safety work to date has been at
the cost to the ratepayer, and if protests continue on a relatively
regular basis, this cost will grow. We did not seek to recover our traffic
management costs from the organisers for the first protest March in
November, but we are seeking to recover the costs for the ongoing marches
using the City’s roads.

 

We are not aware of any other large scale events in Cranmer Square that
may have incurred costs. To assess and provide this information for events
across the district would be a considerable undertaking. We are refusing
this under the following section of the LGOIMA - 17(f) – the information
requested cannot be made available without substantial collation or
research. However, if you have a specific event in mind, we would be happy
to provide this information.

 

The information we hold specific to advice and correspondence regarding
this invoice is considered legally privileged and we have decided to
withhold this undersection 7(2)(g) of the LGOIMA.

 

In the Council's view the reasons for withholding these details are not
outweighed by public interest considerations in section 7(1) favouring
their release.

 

You have the right to request the Ombudsman to review this decision.
