It looks like the Ministry have interpreted your question particularly narrowly. It would have been reasonable for them to answer with any information they have about it, rather than getting stuck on the word "advise". You should be able to get them to interpret more broadly, but it might be faster to just reword your question:
Please provide me any information you have on the legal status Common Law holds in New Zealand. In addition, if it does have legal status, please provide any information about what laws, acts or legislations are superior to it,
You shouldn't need to do that, but sometimes redrafting is the faster option.
