Building Consent Response Times

Dear Auckland Council,

I refer to the document "How to apply for a building consent" located here - http://www.aucklandcouncil.govt.nz/SiteC....

Reading through the document as I understand it:

1. After accepting a submitted building consent you have 20 working days to process the consent.
2. If you find issues with the consent the 'clock stops' and you send a letter asking for clarifications.
3. Once those answers have been submitted you do not 'start the clock' again until "The statutory clock does not restart until all items have been received and checked;"

Can you please clarify the words "received and checked" in the above item 3?

Specifically, can you extend a consent indefinitely by not 'checking' the further information provided? Are you under any obligation to process a consent in any timeframe if you decide to ask for further clarifications?

Under what laws/code are you given the 20 working days or is this self imposed?

Can you please clarify the words "received and checked" in the above item 3? “Received” means when you or your designer submit revised information to the council and “Checked” means when council officer review it. It normally takes 2 to 3 working days to review the revised information depend upon the workload of each individual officer.

 

Specifically, can you extend a consent indefinitely by not 'checking' the further information provided? Are you under any obligation to process a consent in any timeframe if you decide to ask for further clarifications? We cannot extend a consent for indefinite period of time. Council works under statutory time frame stated in Building act 2004 (section 48).Council also have their own policies and procedure to work with.

 

Under what laws/code are you given the 20 working days or is this self imposed? It is written under section 48 of Building Act 2004.
