Good morning Tom,

 

Thank you for your request of 6 January 2021. This request will be managed
under the Local Government Official Information and Meetings Act 1987
(LGOIMA) and Privacy Act 2020.

 

We will do our best to get a response to you by 10 February 2021, this
being the statutory 20 working days after your request was received.

 

Please note that the statutory period of 20 working days for a response
provided by the Act covers the period of Christmas /New Year. This means
that your request may be processed in accordance with Section 2,
Interpretation - (1) (b) of the Act. That is “Working day” means any “day
of the week other than – a day in the period commencing with the 20th day
of December in any year and ending with the 10th day of January in the
following year”.

 

This date also takes in to consideration Wellington Anniversary Day on
Monday 25 January 2021 and Waitangi Day 6 February 2021 – observed on
Monday 8 February 2021 which are not considered working days.

 

However, I can assure you that we will try our best to provide the
requested information as soon as possible.

Can you kindly update me on the above request please?

It is my understanding that, by law, this request should have been processed by at least 15th Feb 2021.

The irony isn't lost on me that this is the same issue i had when placing the x5 hazards - which this request relates to.

My request for a follow up has also been ignored (sent 20/02/2021).

Should this request remain unresolved by COB 03/03/2021 3rd March 2021 i will submit a formal complaint to the ombudsman.

I can confirm that Tony Martin - Operations Manager rang you and spoke with you on 11 January 2021 and provided you with a verbal response, to which he confirmed to me that you were happy with, he confirmed that the work you spoke about had actually been completed. Thanks for your message.

I can confirm I spoke with Tony Martin who informed me that my hazard request had been completed. I did express to him that I was happy that the request was finally completed and was agreeable we could finally close the requests.

However, we did not discuss the OIA and I would deem these requests as two separate entities. As such, I still expect my information request to be honored and processed.

Please correct me if I am wrong, would it be standard practise that an Official Information Act request be resolved over the phone without written correspondence of formal closure/completion?

I would imagine written confirmation is required for transparency and to avoid this confusion.

Else, I am still receiving correspondence from FYI.org.nz that my request is ongoing and outstanding - I would imagine you would have received similar correspondence from them?

Can you kindly confirm when the OIA will be completed?

Good afternoon Tom,

 

Thanks for your reply. Please find attached a copy of the service request
raised for your alerts to Council, as well as a formal response letter for
your reference.

 

One service request was raised and each action was added to the request
and updated. As you can see the conversation between yourself and Tony
Martin was recorded as the last action.

 

In terms of responses to requesters, there is no right or wrong when it
comes to how information is given in response to a request, the Act
(LGOIMA) advises the following:

We don’t receive any alerts or reminders from the FYI.org.nz system, it is
up to the requester to update the alerts from what I can see on the site:

 

 

I will say we have had trouble with that request channel in the past, I
recall a colleague of mines had issues with not receiving requests from
it, but I know we don’t get any sort of alert or reminder for any open
ones. We always recommend that people do also copy in our mailbox address
for OIR’s which can be found on our website here: [1]Making a request -
Kāpiti Coast District Council (kapiticoast.govt.nz) just to make sure we
do receive their request in the first instance.
