1987 (LGOIMA (the Act).

being the statutory 20 working days after your request was received. Your

Your request asked for the following:

 

Please provide all communication (internal and external) between the
Kapiti Coast District Council BCA/TA functions, Infrastructure, Property,
Planning and members of the Waikanae Chartered Club, notably Michael
(Mike) Cardiff, the Chair and any officer of Waikanae Chartered Club and
Nicky Holden, or her team (Property), Shaun Mallon, or his team
(Infrastructure), Steven Cody, or his team (BCA/TA) in respect of 4
Elizabeth Street including the possible sale and purchase of the KCDC land
providing access to the rear of number 4 (identifier 625861, Section 1
Survey Office Plan 35434) and all communication relating to the proposed
development of Number 4 Elizabeth Street, Waikanae.

 

Refinement of your request

 

Staff have considered the work involved in collating the information to
answer your request for ‘all communication (internal and external)”
pertaining to 4 Elizabeth Street and have concluded that it will take a
considerable amount of time to collate the information and consider
whether it can be released, it is possible that there could be hundreds if
not thousands of records relevant to this address and the people you have
listed in your request.

 

I am therefore writing to you to invite you to refine the scope of your
request to be more specific about the information you are seeking. For
example, can you tell us whether you would like to receive information for
a specific period of time, it is helpful for us to have some parameters to
search within.

 1. When we receive your refined request, we will need to consider whether

 3. In instances where requests encompass a wide timeframe and require
large amounts of information to be searched, legislation can enable
Council to refuse such a request under section 17(f) of the Act as
“the information requested cannot be made available without
substantial collation or research”.

As you know we are working on the response to your request for information
related to 4 Elizabeth Street and Waikanae Chartered Club. We had hoped to
have a response out to you today, however, due to staff constraints and
some staff being called in at late notice to work on Council’s response to
the Covid-19 protection framework protocols we will have to extend the
date of our response to you to close of business Wednesday 15 December
2021.

 

We have the information collated and have been working on the necessary
redactions etc. We just have to go through some final steps before we can
send the information to you, we’re almost there, we just need a little
extra time.

My sincere apologies.  Unfortunately the staff member working on your
request has had to take urgent leave, and reviewing redactions before
management sign-out is difficult without their input/access.  I can assure
you that the decision has been to grant your request, it the timing that
is the issue.  I will do my utmost to provide this information to you by
Friday 24 December 20201.
 
FYI - the redactions for review are on the basis of Out of Scope, and
under the following sections of the Act:
•       7(2)(a) – to protect the privacy of natural persons
•       7(2)(g) – to maintain legal professional privilege
•       7(2)(h) – to enable any local authority holding the information to
carry out, without prejudice or disadvantage, commercial activities.
 
Perhaps if you are not intending to use the file over the holiday period
it would be of great help to me if we could provide by 10th January at the
latest? I am back in the office on the 5th and will make it my priority. 
If we do not hear from you we will to continue on the basis that Friday is
the cutoff.
