Hello Shane
I am writing in response to your OIA request of 3 July 2020 for:
“copies of all Memorandum Of Understanding (MOU’s) signed in the last five
years related to the sharing of data to organisations outside your
organisation.”
I am mindful that a response to your request has taken longer than we
anticipated when advising you of an extension to the timeframe. I
apologise for this delay and any inconvenience it has caused you. I can
assure you that we are progressing your request as quickly as possible.
Given the significant period of time that has elapsed since you lodged
your request with MBIE, I wanted to confirm that you still required a
response. If a response is no longer required, please let me know.
Otherwise we will continue working to provide you a response as soon as
possible.
Again, I apologise for this delay.
Kind regards
Jon Little

Dear Jon Little,
Yes please I would still like the information I requested.
Yours sincerely,

Ministry of Business, Innovation & Employment
Thank you, Shane.
We are continuing work on your OIA request and will respond to you as soon as possible.
In order to speed our response, I wanted to seek clarification as to the scope of your request. Are you interested, primarily, in government agency to government agency MoUs? Or are you also interested in any MoUs MBIE holds between MBIE and non-government sector organizations?
Cheers
Jon

Dear Jon Little,
I am disappointed that you have waited months to clarify the scope of this request.
It is a strong indication that MBIE have not actually been working on this request in the months it has been outstanding.
To answer your question I am happy to receive just "in government agency to government agency MoUs" and not "MoUs MBIE holds between MBIE and non-government sector organizations"
I will be disappointed if I receive an update to this request that tells me I have refined my request and therefore you are starting the 20 day clock again so you can meet you OIA reporting metrics.
Yours sincerely,
Shane Gibson

You're likely aware of this already, but the OIA only allows for the clock to be restarted in that way if the agency asked for clarification within 7 working days of having received the request (see Section 15(1AB)(b) of the OIA). Clearly, that is not what has happened here.
