Thank you for your request received on 7 July 2020 asking for ‘copies of
all Memorandum of Understanding (MOUs) signed in the last five years
related to the sharing of data to organisations outside your
organisation.’

 

In order to determine whether MPI can satisfy your request, we would like
to clarify what information could fall within scope. There are two areas
where we require clarification.

 

 1. Definition of ‘MOUs’ – MPI holds multiple types of agreements that can
encompass information sharing between organisations, for example,
operational or contracted work, data sharing agreements and
relationship agreements. Could you confirm that you are only seeking
those agreements where information sharing is the primary focus of the
agreement?

 

 2. Definition of ‘organisation’ – As MPI is a large government agency
with five separate business units encompassing a wide variety of work,
we liaise with many external organisations and agencies. Could you
clarify what is meant by ‘organisation’? Would you be happy to receive
MOUs that MPI holds with other core New Zealand government agencies?
If your request intends to encompass a wide range of organisations
hundreds of agreements could fall within scope, and as such, MPI may
not be able to satisfy your request due to substantial collation or
research under section 18(f) of the Official Information Act.

 

We would like to note that this request will likely require multiple
consultations with the other organisations involved in any MOUs before we
can release this information to you. It is more likely that MPI will be
able to satisfy your request should you consider refining scope.

 

Please note that once you have amended or clarified your request, under
section 15(1AA) of the OIA, MPI may treat your amended request as a new
request and restart the statutory response period.
