Dear South Canterbury District Health Board,

Pursuant to the Official Information Act 1982 please provide copies of all Asbestos Management Plans prepared under Regulation 13(2) of the Health and Safety at Work (Asbestos) Regulations 2016 for all workplaces occupied or from time to time occupied by the District Health Board where asbestos or ACM (Asbestos Containing Material) is suspected to be or has been identified at the workplace.

With regards to your OIA request re “Asbestos Management Plans”.

 

Unfortunately many key staff involved with the sourcing and preparation of
material for your OIA request are also directly involved with work
associated with COVID-19.

 

This has impacted on our ability to respond to OIA requests within normal

Dear Dawne Tuite,

I appreciate the issues with the COVID-19 outbreak but also note that your management administration staff should have had this information to readily to hand. If a WorkSafe Inspector had turned up requiring it to be produced they would not have had the patience I have shown to date.

I also record again that this request was originally sent to South Canterbury DHB on 1 February 2020.

Dear Dawne Tuite,

I do not believe that the South Canterbury District Health Board has supplied the information that was requested. I was very specific with what was requested, which was copies of all Asbestos Management Plans prepared under Regulation 13(2) of the Health and Safety at Work (Asbestos) Regulations 2016 for all workplaces occupied or from time to time occupied by the District Health Board where asbestos or ACM (Asbestos Containing Material) is suspected to be or has been identified at the workplace.

A procedure fulfil the request, nor does it comply with the requirement as set out in the Health and Safety at Work (Asbestos) Regulations 2016.

Please provide a full copy of the Asbestos Management Plans as originally requested by the end of May 2020, or I will refer this request to the Ombudsman's Office as a refusal without reasonable cause.
