Re: Former Elim Church Site, 305 Broadway Marton - Costs to maintain and has Council purchased the property.
With reference to the minutes of the Council Meeting dated 28/9/2017, minute number 17/RDC/296, please confirm the following:-
1) Please provide a copy of the MOU between the council and the Elim Church,
2) Please provide the total costs council has incurred maintaining the site broken down in to labour and materials,
3) Has council exercised the right to purchase the property? If so, (a) confirm date contract was signed,(b) purchase price , (c) date sale was settled and (d) has council assumed responsibility for the issue of the shared wall with 'Cooks'.

Good afternoon Robert
Here is our response to your official information request. Our answers are provided to each of your questions below:
1) Please provide a copy of the MOU between the council and the Elim Church
There is no MOU in place between the Council and the Elim Church. There is a signed letter of agreement between the Council (written by His Worship the Mayor) and Mr Graham Moore (Marton Elim Church), this is attached.
2) Please provide the total costs council has incurred maintaining the site broken down in to labour and materials.
We are unable to provide specific costs for this question, as the improvement and re-grassing of this area was a community driven initiative, supported by the Parks and Reserves Team Leader, who provided minimal time within his Parks role and some of his personal time.
3) Has council exercised the right to purchase the property? If so, (a) confirm date contract was signed,(b) purchase price , (c) date sale was settled and (d) has council assumed responsibility for the issue of the shared wall with 'Cooks'.
Council has exercised the right the purchase the property, however, under section 17(d) of LGOIMA we are refusing the remaining section of your request. The information you are requesting has only been considered by Council in the 'public excluded' section of their meeting, therefore until this information is made public we are unable to fulfil this part of your request.

Dear Carol Gordon,
In respect of:-
Q.2 - The Council Minutes clearly states that the council will maintain the site and in exchange council will have first option to purchase. In negotiating the purchase the costs to maintain the site will have been known albeit generalised. Regardless of community involvement, there is photographic evidence of council staff maintaining the site during normal business hours. Please provide the costs as requested.
Q.3 - In respect of the purchase price, in is not acceptable to hide behind section 17(d). The Mayor made it public during the consultation process for the purchase of the site opposite (Cobbler to Sash and Door Buildings) the agreed price with the vendor.
Finally, you did not state whether the council had assumed liability for the 'party wall' issue with Cooks Bar as part of the property transaction. The council had issued a notice to fix to the previous owner which was upheld by the MBIE. Please provide this information and the cost to remedy.
