Under the provisions of the Official Information Act I request the following information:

1. A summary of the total costs that the Tasman District Council incurred in their response to the Tasman Fires that commenced on 5th February 2019. These would be the additional costs as a direct result of the fires that were incurred over and above “Business as Usual” for TDC.

2. The Incident Action Plans (IAPs) for the first ten days as prepared by the Incident Management Team (IMT) that managed the civil defence response to the Tasman Fires under the declaration of a State of Emergency (6th Feb 2019).

3. If not included in the IAPs as requested above, the analysis and documentation that was signed off by Tasman’s Incident Controller (IC) that set out the basis of the decision to order an evacuation of Wakefield.

4. If not included in the IAPs as requested above, the analysis and documentation that was signed off by Tasman’s Incident Controller (IC) that set out the basis of the decision to order evacuations in and around Brightwater.

Thank you for your request for information received on 16 April 2019.

Under The Local Government Official Information and Meetings Act (LGOIMA), your request must be dealt with as soon as is reasonably practicable and in no case later than 20 working days after the day on which the request is received. 20 working days excludes Saturdays and Sundays, Public Holidays and the period between 20 December and 10 January inclusive. On this basis, we calculate a response to your request received is due by 17 May 2019, at the latest. We shall of course endeavour to process your request as quickly as staff resources allow.

For requests that are likely to involve substantial collation and/or research, there may be a charge for staff time. Under our charging policy, staff time for the first hour is free of charge. Thereafter this will be charged at the prescribed rate of $38 (GST inclusive) per half hour. In addition, there will be photocopying charges at 20c per sheet, with the first 20 pages being copied free of charge. Under clause 13(4) of LGOIMA we do have the ability to request the amounts due are paid in advance of the release of information. Please be assured that if a charge is likely to apply you will be notified ahead of the request being processed so that you can decide if you wish to proceed. At that time you will also be given the option to refine your request.

This is because consultation with other agencies is required (eg. Nelson
City Council and Civil Defence Emergency Management 'CDEM') so that a
proper response can be given.   Section 14(1)(b) of the Local Government
Official Information and Meetings Act 1987 (LGOIMA) applies.

 

I must advise you of your right to complain to an Ombudsman about this
extension of time.  This right to complain is dealt with in section 27 of
the LGOIMA.

Good afternoon Alan,

 

With reference to your e-mail below, we continue to consult with other
parties to prepare a proper response.  In the meantime – see below our
response to Part 1 of your request:  “A summary of the total costs that
the Tasman District Council incurred in their response to the Tasman Fires
that commenced on 5th February 2019.  These would be the additional costs
as a direct result of the fires that were incurred over and above
“Business as Usual” for TDC. “

 

Costs that fall within the scope of your request have yet to be
finalised.  This is because costs relating to the Pigeon Valley fires are
still being incurred and processed. 

 

We are due to meet with Nelson City Council to discuss how and when these
can be quantified for the purpose of reporting to our respective
Councils.  We anticipate to be in a position to do so at the Tasman
District Council meeting scheduled for 2 August 2019.  The report
containing those details will be available as part of the Council agenda
uploaded to our website at least two working days prior to that meeting
date. 

 

Our response is therefore that the information will soon be publicly
available and so section 17(d) of the Local Government Official
Information and Meetings Act 1987 (LGOIMA) applies to this part of your
request.

 

We hope to provide the balance of our response on or before 10 June 2019,
as previously advised.

Further to our previous response below, unfortunately we have been unable
to complete our consultation with staff members at CDEM, although we have
identified the material that may be relevant to the scope of your
request.  In order to formulate a proper response, it is necessary to
continue with consultation and review of the said material. 

 

In light of the above we must apply a further extension of five working
days under section 14 of the Local Government Official Information and
Meetings Act 1987 (LGOIMA).  This means a response will be due on or
before Monday 17 June 2019.  You have a right to complain to the Ombudsman
about this extension of time.  This right to complain is dealt with in
section 27 of the LGOIMA.

In relation to your request for information (shown in black type below),
our responses are in red and reference the attached:

prepared by the Incident Management Team (IMT) that managed the civil
defence response to the Tasman Fires under the declaration of a State of
Emergency (6th Feb 2019).

 

3.            If not included in the IAPs as requested above, the analysis
and documentation that was signed off by Tasman’s Incident Controller (IC)
that set out the basis of the decision to order an evacuation of
Wakefield.

 

4.            If not included in the IAPs as requested above, the analysis
and documentation that was signed off by Tasman’s Incident Controller (IC)
that set out the basis of the decision to order evacuations in and around

Please find attached the information (combined into one document) that
falls within the scope of your request:

 

-          SITRep 1 - pre declaration lists FENZ as the lead agency
identifying the first evacuations/self evacuations. FENZ are the agency
responsible for holding any information on how that decision was reached,
as at the time they were the lead agency.  It is not clear whether you
have already approached FENZ with the same request.  If not, you can
either make that request directly to that organisation, or we can transfer
this request to them under the Local Government Official Information and
Meetings Act 1987 (LGOIMA).

 

-          Action Plan 4 - post declaration which includes commentary
around the potential for evacuation from Wakefield.

 

-          Plan A is the evacuation plan for Wakefield.

 

-          Shift 5-6 handover notes captures narrative around evacuations
from agency debriefs throughout that shift.

 

-          Decision log captures all decisions made relating to Wakefield
and Brightwater.

believe you have been given a reasonable response to your request.  This

Dear Ms Redgrove,

Back in May I requested under an OIA details of TDC's costs with respect to the Tasman Fires (primarily Pigeon Valley).

In your response you advised:

"We are due to meet with Nelson City Council to discuss how and when these can be quantified for the purpose of reporting to our respective Councils. We anticipate to be in a position to do so at the Tasman District Council meeting scheduled for 2 August 2019. The report containing those details will be available as part of the Council agenda uploaded to our website at least two working days prior to that meeting date. I have looked through the TDC web site and can not find a meeting scheduled for 2 August. There is one scheduled for 1 Aug but there are no papers or reports included with this notice other than something about the Golden Bay Grandstand.

Can you please advise further with respect to where the report is with regard to the fire related costs. Please not that the Ombudsman does not consider that Section 17(d) of the Act to refuse to provide information where there information is not then published after 8 weeks of the refusal. This 8 weeks has now passed since your notice.
