Status of code compliance certificates

Tony Bach made this Official Information request to Tasman District Council

This request has an unknown status. We're waiting for Tony Bach to read recent responses and update the status.

From: Tony Bach

Dear Tasman District Council,

How many code compliance certificates are still outstanding for consented building activities, grouped by year of consent granted?

I understand that a code compliance certificate is required within 2 years of consent.

www.building.govt.nz states "Building consent authorities need to be proactive in the way they manage issuing code compliance"

Does TDC comply with this requirement

Yours faithfully,

Tony Bach

Good afternoon,

In relation to your request for information, below is a table of Consents
as requested (please note some of the consents may include PIM’s,
Amendments and COA’s which wouldn’t require a CCC)

If you would like this report without PIM’s, Amendments and COA’s this is
possible but may take several hours to collate which would be chargeable.

*please note that some 2017/2018 consents have not currently meet their
two year anniversary

Building Assurance as an accredited Building Consent Authority have the
obligation to meet the Building Act 2004, we are audited in a two yearly
cycle by IANZ to ensure we meet our obligations.

We have procedures in place to cover sect 92 to 95 of the Building Act
2004 (came into effect 31 March 2005) which relates to the Issuing of Code
Compliance Certificate and making a decision to Issue or Refuse the Code
Compliance Certificate within 2 years of the Building Consent being
granted. This includes sending a reminder to the Owner of the property on
the 22 month anniversary of the consent being granted to advise their Code
Compliance Certificate is outstanding. On the 2 year anniversary a
technical staff member reviews the consents and chooses to Issue or refuse
the Code Compliance Certificate.

I must advise you of your right to complain to an Ombudsman if you do not
believe you have been given a reasonable response to your request.  This
right to complain is dealt with in section 27 of the Local Government
Official Information and Meetings Act.

Please note that we now have a dedicated e-mail address
[1][Tasman District Council request email] to receive requests for official information.
Direction of future requests to this e-mail address will assist in
processing time.

Kind regards,

Kate Redgrove, Executive Advisor
