Roll of Ratepayer Electors in 2010 Auckland Elections

Dear Auckland Council,

I refer you to the document titled LOCAL AUTHORITY ELECTION STATISTICS 2010, published by the Department of Internal Affairs.

Page 57 of that report says that 1,574 votes were received from Ratepayer Voters (meaning Ratepayer Electors, as defined by the Local Electoral Act 2001).

My request is that you provide, either:

(1) an extract from the 2010 Auckland roll, giving the names and address details of all voters who registered as Ratepayer Electors in each Auckland Council Ward, and in each Local Board area; or

(2) The complete 2010 Auckland roll, clearly identifying which voters were registered as Ratepayer Electors in each Auckland Council Ward, and in each Local Board area.

Dear Mr Doherty,

I am sorry, but your response is incorrect. Perhaps I need to explain my request in more detail.

I refer you to the Local Electoral Act 2001 - in particular sections 24, 38 and 42.

Section 24 says a Ratepayer Elector must be identified on the valuation roll of a local authority. This is information held by the local authority and not by the electoral commission.

Section 38 says the Electoral Officer of each Local Authority is responsible for compiling an Electoral Roll for local elections, which must include the details of every Residential Elector and every Ratepayer Elector.

The Electoral Commission must supply data to the local authority regarding residential electors. However the rolls of ratepayer electors are compiled by the Electoral Officers of the local authorities. They are not required to supply that information to the Electoral Commission, so the information is not publicly available in the manner you suggest.

Section 42 says the electoral roll must be kept at the principal office of the local authority, among other places, and must be available for inspection at those places.

The information I have requested comprises the roll/s of Ratepayer Electors, that were compiled by the electoral officer/s for the 2010 local government elections in what is now the Auckland Council's district, and which should have been available for inspection after the roll had closed (per s. 50 of the Act).

I apologise: the information I requested was partly available at my local library - just not where I was initially directed by the librarian.

The full set of information has now been supplied to me by Independent Electoral Services Ltd, at a charge of $213.00 for collation and copying.
