Thank you for your email of 26 March 2019 to the Ministry of Business,
 Innovation and Employment requesting, under the Official Information Act
 1982 (the Act), the following information:
 
Could I please have a copy of the current complaint file in regards to
 complaints and investigations in regards to LBP Mark Hanson BP130700. I
 acknowledge that personal details of witnesses, etc, may be redacted. This
 includes copies of any complaints that didn't meet your threshold for
 investigation, as well as any notes, memos, recordings and witness
 testimony recorded by investigators or submitted by complainants.

 without a privacy waiver from the complainant or Mark Hanson. Could you

    Dear CLM Ministerial Services,
Thank you for your response. It is noted when a complainant submits a complaint, they are notified that any complaint is subject to the Official Information Act. Obviously personal details of complainants would be redacted. This appears to contradict with your response that ALL information is withheld on the grounds of privacy.
The complainant for C2-01942 will provide a waiver, but obviously the Licensed Building Practitioner will not. Again this seems contradictory to your initial response in regards to public records of Licensed Building Practitioners and the protection of the public. It is also unusual for an authority to expect a member of the public to seek privacy waivers from all those involved in a complaint, when it is the authority's responsibility to manage private information, and you are able to redact if necessary. Complaints about an LBP should be public information as per the LBP Board regime.
Are there also other complaints that the Registrar refused to investigate? This should be public information. Again, a member of the public can't possibly get waivers from these complainants and the LBP Board can simply redact personal information.

Thank you for your response. The original request asked for a copy of all complaints about LBP Mark Hanson, it is you that limited it to the publicly released decision.
We would like a copy of any complaints (with personal details redacted as necessary) including those that the LBP Board did not investigate further as this is completely consistent with the original request for ‘complaints’.
