Dear Shaun,
We write under LGOIMA in relation to the FNDC press release of 18 September, 2018, entitled “Council Launches Dog Registration Checks”.
Would you please provide information on Council’s understanding of the legal right for Animal Management Officers to enter properties in a manner as outlined in that press release.
We understand Animal Management Officers (AMOs) do not in fact have a legal right to "visit homes on randomly-selected streets ... to update records and check that dog registrations are current", or to provide unsolicited advice.
We look forward to your clarification of this.

I am able to update you on the status of RFS-3913482. You requested an
explanation of the councils understanding regarding the rights for Animal
Control Officers to enter properties. Our legal officer advised that this
was not official information based on you requesting an explanation and
asked our Animal Control Department to respond. Our Animal Control
Department have advised that Officers warranted under the Dog Control Act
1996 have powers of entry under that Act. Also the general law recognises
that any person, including a dog control officer, has an implied licence
(or permission) to enter onto private land for the purpose of making a
reasonable enquiry of the occupier.
