(If this is still in draft i still wish to have a copy of the latest version)

2. Can you please send me the latest version "Council's Standard Operating Procedures" as stated in section 11.3 of the Draft Far North District Council Dog Control Bylaw 2016 (doc A2078666)

Please note these referred documents have never been included with any release of any version of Draft Dog Bylaw relating to impounding for public scrutiny.

I refer to your official information request received 2 July 2018
regarding the far North District Council’s operating procedures. Your
request has been referred to Legal Services for consideration under the
provisions of the Local Government Official Information and Meetings Act
1987 (“the LGOIMA”). 

 

The Local Government Official Information and Meetings Act requires that
we advise you of our decision on your request no later than 20 working
days after the day we received your request. Unfortunately, it will not be
possible to meet that time limit and we are therefore writing to notify
you of an extension of the time to make our decision, to 10 August 2018.

 

This extension is necessary because key Council staff vital to the
provision of the information you seek are not available for consultation.
The delay has been unexpected, however, we will aim to provide you with
the information as soon as possible, at the latest 10 August 2018.

 

You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at

I refer to your email received 2 July 2018 regarding the Far North
District Council’s operating procedures. Your request has been referred to
Legal Services for consideration under the provisions of the Local
Government Official Information and Meetings Act 1987 (“the LGOIMA”). 

 

Thank you for your patience regarding the extension we had advised, which
was that a further response would be provided to you by 10 August 2018.

 

You had requested a copy of Council’s ‘Operating Procedures – Dog
Management’. Whilst it is Council’s intention to provide you with a copy
we are unable to provide you with it today.

 

Council has tasked itself with upgrading, improving and reviewing its
‘Operating Procedures – Dog Management’. Advice has been sought from the
SPCA and we continue to work with the organisation. Animal Management have
workshopped policy and procedures relevant to the organisation. At this
point in time whilst our operating procedures are well understood and
carried out by staff, the reviewed and renewed operating procedures have
not yet been committed to paper in entirety. Whilst Council understands a
draft copy can be provided, we do not currently hold a collated draft of
Council’s current ‘Operating Procedures – Dog Management’. The delay is
unexpected, however there has been no set deadline for documented
completion. Council is committed to the continued improvement of its
Animal Management services and shelter operations. Once a collated draft
of Councils ‘Operating Procedures – Dog Management’ is held by Council, we
will provide you with a copy.

I am responding to customer reference 3897623, my LGOMIA request you received on 30th June 2018.

Thank you for the information but unfortunately the response was not forthwith with the information requested.

1. I would like the actual copy (even in draft) that was referenced "Council's Standard Operating Procedures" as stated in section 11.3 of the Draft Far North District Council Dog Control Bylaw 2016 (doc A2078666). If this document does not exist I feel the legitimacy of the draft dog control bylaw would in invalid as all referenced material was not made available to councillors and for Public Consultation.

2. I would like the actual copy (even in current draft) that is referenced in "Council's Operating Procedures" as stated in section 10.2 of the Draft Dog Management Bylaw 2018 (doc A2084226) so I can make an informed submission to the Dog Management Policy and Bylaw 2018. I believe this document should be included within the draft Dog Management Bylaw 2018 for completeness to ensure A governance and accountability framework of the Local Government ACT 2002.

Could I have a copy of these two documents as an urgent request as public submissions close 24 September 2018.

Thank you for your further enquiry.

Council have very clear operating procedures regarding dog management. As previously advised the revised and updated operating procedures have not been committed to writing, even in draft form, however this does not mean they do not exist. Council's Animal Management Team attend in-house workshops to ensure they are up to date with current operating procedures regarding dog management. Council is also largely guided by the Dog Control Act 1996 as well as other governing legislation and plans such the Animal Welfare Act 1999 and related codes of welfare, Reserves Act 1977, Conservation Act 1987, Wildlife Act 1953, Resource Management Act 1991, Local Government Act 2002 and the Far North District Council District Plan.
