2. Pack #5 - Why did the council release this contract under direct appointment and not through GETS? Could you please release all communication with respect to this package?

Council Response
1. Please find attached a copy of the Request for Quote (RFQ) issued
for Pack 2. This RFQ contains the following requested information:
· Details of the package
· Scope of Works
· Criteria for shortlisting tenderers
We have not included the names of the shortlisted tenders due to
commercial sensitivity surrounding these companies’ market activity and
also due to confidentiality related to their commercial intentions.
2. Pack 5 was awarded under direct appointment due to the proximity
of the awarded supplier and the critical inter-dependency of another
Council capital project which urgently required materials subsequently
recovered from the Pack 5 phase. We have not included email
communications related to this package due to commercial sensitivity and
confidentiality.
3. To clarify, an EOI was not issued for any Lancaster Park
procurement activity. This was an administrative error in the previous
response - it should have stated RFI not EOI. Please accept my apologies
for this. A Request For Information (RFI) was issued which is a tool to
gain and understand market/industry information only and to aid Council in
its procurement planning. This RFI did not request any pricing or cost
information whatsoever, as is the nature of RFI, and so we are unable to
provide a range of costs.
Withholding of information
The Council has decided to withhold some information under the following
sections of the LGOIMA:
- 7(2)(b)(ii) – to protect the commercial position of the person
who supplied or who is the subject of the information
- 7(2)(c)(i) – to protect information which is subject to an
obligation of confidence, where the making available of the information
would be likely to prejudice the supply of similar information, or
information from the same source
- 7(2)(h) – to enable any local authority holding the information
to carry out commercial activities
In the Council's view the reasons for withholding these details are not
outweighed by public interest considerations in section 7(1) favouring
their release.
You have the right to request the Ombudsman to review this decision.
