I refer to your email received 6 April 2018. Your request has been
referred to Legal Services for consideration under the provisions of the
Local Government Official Information and Meetings Act 1987 (“the
LGOIMA”). 

 

Your request

 

“I am requesting all information (oral and written), including copies of
any communication, memoranda, talking points, correspondence, reports or
briefing notes relating to the appointment of Murray McCully as a director
of Far North Holdings Limited.  This includes copies of any call or for
nominations for the post of director, including any advertisements or
notices, and all other expressions of interest or applications received
for the post of director, in addition to any expression of interest or
application from Murray McCully.”

 

Our response

 

Please find attached information held by Council relevant to your request
(refer zip file RFS 3881573). Pursuant to section 7(2)(a) of the LGOIMA we
have withheld the names and personal details of the candidates who applied
for the role. We consider the withholding of this information is not
outweighed by other considerations which render it desirable, in the
public interest, to make that information available.

 

The expressions of interest regarding the advertised role received by the
organisation were in the form of resumes emailed by each candidate. The
resumes were provided to the organisation with an expectation that such
information will be kept confidential. Pursuant to section 7(2)(a) of the
LGOIMA we find it necessary to withhold resumes received and held by the
organisation to protect the privacy of natural persons. Again, we consider
in this instance that the withholding of the information is not outweighed
by other considerations which render it desirable, in the public interest,
to make that information available. 

 

We also refer to the Privacy Commissioner for assistance regarding the
protection of information in reference to job applications held by an
employer and we note that the Privacy Commissioner has published the
following: “An employer can keep the information for as long as they need
it and they should only use it to assess an individual’s suitability for a
particular role. Once it has been used for that purpose, the employer
should destroy it and not disclose it to others”.

Official Information request complaint: 3881573

 

We refer to your complaint to the Ombudsman regarding the Far North
District Councils’ decision on his request for information regarding the
appointment of Murray McCully as a Director of Far North Holdings Limited
(FNHL).

 

We have advised the Ombudsman that Council can provide you with further
information today on your request.

 

An email from our Legal Services Manager to our General Manager of
Corporate Services appears to have been missed in the initial disclosure.
This was not information missed by intention nor was it withheld. The
email relates to the decision of appointing an additional director to
FNHL. Refer attached.

 

Regarding Mr McCully’s resume, Council do not release copies of resumes of
any applicant to the public whether they are successful in a position or
not. Whilst a resume of a successful candidate may be retained by Council
(only if required), this does not mean that Council will disclose it.
However upon closer inspection the resume we hold for Mr McCully is
information that is available to the public. Please refer to the following

Regarding the redaction of remuneration within the letter provided to you:
Audit NZ requires that certain salary information is published by
territorial authorities. This includes salaries of Councillor’s, the
Deputy Mayor, Mayor as well as the CE. The salaries of the employees of a
territorial authority (except the CE) are published by salary band width.
In regards to the redaction of remuneration you refer, we were following
this rationale. However, upon reflection the letter states maximum figures
which do not necessarily reflect an actual remuneration figure.  We have
also further considered the fact that Director remuneration may in fact be
public information. The letter in its entirety is attached for you.
