Innovation and Employment requesting, under the Official Information Act
1982 (the Act), the following information:
· Could I please request the test certificate for the 2017
Wellington Sky Show fireworks display and all other associated documents
with this event.
This email is to advise you that your request has been transferred to
WorkSafe NZ.
This is because your request is more closely aligned with the functions of
the WorkSafe NZ. Section 14(b)(ii) of the Official Information Act allows
me to transfer any request that is believed to be more closely aligned
with the functions of another department, organisation or Minister of the
Crown.

This email is to notify you that WorkSafe New Zealand is partially
transferring the highlighted part of your request to Wellington City
Council (WCC) in accordance with section 14 of the Official Information
Act 1982.
This partial transfer is occurring because the information you requested
is believed by WorkSafe to be more closely connected with the functions of
WCC.

I refer to WorkSafe’s letter dated 7 March refusing your request for the
Test Certificate for the Wellington Sky Show fireworks display on the
grounds that they do not hold this document. Although this part of your
request was not transferred to us, we do hold this document and
accordingly please find the test certificate attached.
You have also requested all other documents associated with the Wellington
Sky Show and this part of your request was transferred to us by WorkSafe
on 22 February 2018. As outlined in my email of 2 March 2018, given this
is a significant event for us, we have identified that providing all
documents associated with the Wellington Sky Show would amount to
substantive collation.
As required by section 17A of the Local Government Official Information
and Meetings Act 1987 (LGOIMA), we have considered whether charging or
extending the timeframe for responding to your request would help, and
have concluded that neither option would relieve the burden on a small
number of officers of putting together the information.
As required by section 17B of LGOIMA we have consulted with you, to see if
you could refine or clarify your request. However, at this stage we have
not heard back.
Accordingly we are refusing your request on the basis of LGOIMA section
17(f) on the grounds that providing all documents associated with the
Wellington Sky Show would amount to substantive collation or research. If
you wish to discuss this decision with us, or are willing to change or
refine your request, please feel free to contact me at the details below.
You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
