Please provide a copy of any procedures, policies, manuals, instructions, or similar that are used when (i) ascertaining whether a person will be required to apply for an overseas pension and (ii) ordering a person to apply for an overseas pension.

Please include all amendments to these procedures, policies, manuals, instructions, or similar that have been made since 1 January 2009.

I am a New Zealand citizen resident in New Zealand.

Thank you for your request received 20 November 2017 for information
regarding the requirement to apply for overseas pensions.

 

The requirement to apply for overseas pensions prior to receiving New
Zealand Superannuation is based on section 69G of the Social Security Act.
This legislation is available online here:

The approach and procedures to apply section 69G and deductions for
overseas pensions set out in section 70 of the Social Security Act can be
complex and will depend on the various countries people can receive
pensions from. As it stands, your request therefore includes a large
number of documents which would take considerable time and resources to
compile. As such, we would be looking to refuse your request under section
18(f) of the Official Information Act as substantial manual collation
would be required to locate and prepare all documents within scope of your
request.

 

If you wish, we could provide copies of procedural documents regarding the
application of section 69G and section 70 of the Social Security Act.
Alternatively, if you are interested in the requirement to apply for
pensions for a specific country, we may be able to provide you with
information regarding the procedure for clients who may be eligible for
pensions from this country.

MSD has extended the deadline within which to respond.

This is a straight forward request for their operating procedures re requiring poeple to apply for the Australian pension.

I am complaining to the Ombudsman about the delay.
