You may want to avoid saying that you'd understand if they needed to react information. While it's great to have requested who are understanding, it might give them the invitation to withhold more than is necessary, pursuant to the Act. They might try to withhold more, because you are accommodating.

Hi Harriet,

You might also find https://fyi.org.nz/request/5994-informat... useful when they reply as that should return any reports from KR/AT as to the suitability/etc of the tunnel for passenger services (assuming RLB asked for them before making it Local Board policy).

(The linked report in that request also mentions the Waitakere Tunnel, but merely costs, no other description)

Thank you for your email dated 18 June 2017, received by KiwiRail on 19
June 2017, in which you request the following information:

 

“Would it please be possible to be released any relevant information on
the following understand if sections would have to be redacted.

1. Why the Waitakere tunnel cannot be used for passenger services anymore?

2. European Train Control System Level 2 for the Auckland Rail Network?

3. Grade separation of junctions on the Auckland Rail Network?”

 

Your request has been considered under the Official Information Act 1982
(the Act).

 

In response to question 1, the Waitakere Tunnel can be used for passenger
services operated by KiwiRail provided they are pulled by locomotives that
comply with the Semi-Permanent Bulletin 381 (see below).

Any proposed passenger service (not operated by KiwiRail) would require a
risk assessment to be carried out and that risk assessment would need to
ensure that adequate steps were going to be taken to ensure an appropriate
level of fire safety would be maintained, and this would need to be
approved by the Rail Regulator.

 

In respect of question 2, we have reviewed your request and found that the
scope is too broad and would result in large research and collation. 
Accordingly, we ask that you redefine the scope, for instance by
identifying the particular information you would like that is specifically
related to question 2.  It would also be helpful if a timeframe is
defined.

 

In respect of question 3, KiwiRail has done some initial grade separation
concepts for Westfield Junction but it’s not clear whether you are asking
for that, or for information about each junction in the network. If it’s
the latter then the scope is too broad and would result in large research
and collation; if the former we can provide you with some information. 
Accordingly, we ask that you redefine the scope, for instance by
identifying the particular information you would like that is specifically
related to question 3.  It would also be helpful if a timeframe is
defined.

 

Please advise if you wish to redefine questions 2 and 3. Otherwise, we
will regard these parts of the request as refused under s18(f) of the Act.

 

Under s28(3) of the Act, you have the right to seek an investigation and
review of this response by way of complaint to the Ombudsman. Refer to

Thank you for your email response on 13 July 2017 clarifying your request (from the below email dated 18 June 2017) for the following information:

Question 3: The former [KiwiRail’s initial grade separation concepts for Westfield Junction]”

Your request has been considered under the Official Information Act 1982 (the Act).

In response to question 2, there are no reports comparing Levels 1 and 2 ETCS for use on the Auckland Rail Network. This is because at the time when resignalling was being tendered (2008), Level 1 met the capacity, risk mitigation and other requirements identified as part of that project. In any event, Level 2 was not offered by any tenderer and was not fully developed at the time.

In response to question 3, the attached drawings are concept ideas only of a range of grade separation options for Westfield Junction that have been done for the sole purpose of identifying future rail corridor needs. This work was done to ensure that the proposed East-West road alignment supported a range of future rail alignments.

These drawings are not formal proposals in any way and are not included in any formal planning processes such as ATAP etc.
