Thank you for your email of 4 May 2017 requesting the following
information under the Official Information Act 1982 (the Act):

 

‘Back in November I made a request for the Third Main Business Case & was
rejected in January as was before Minister of Transport & the KiwiRail
Board.

 

Has the Business Case now been considered and thus can be released to me?’

 

This letter is to advise you that the NZ Transport Agency is transferring
your request as the information is more closely connected with the
functions of KiwiRail. Since the time of your last request, the Transport
Agency has handed over the work on the business case to KiwiRail.

Accordingly we are transferring your request under section 14 of the Act.

 

You will therefore receive further correspondence on your request from
KiwiRail.

We refer to your request for information transferred to KiwiRail from NZ
Transport Agency, on 10 May 2017, in which you request a copy of the Third
Main Business Case.

 

Your request has been considered under the Official Information Act 1982
(the Act).

 

One document has been identified as being within the scope of your request
however KiwiRail has decided to publicly release the document therefore,
we are withholding the document in full under s18(d) of the Act.

 

The Business Case will soon be made available to the public. KiwiRail will
contact you separately next week to advise when and where the public can
access the document.

Given the Third Main Business Case (entitled "Wiri to Westfield: the case for investment") was released with redactions, will you be asking the Ombudsman to review the decisions by Kiwirail to redact particular parts of the report? I note that the BCR has been redacted*.

I note also that on TV3's "The Nation" programme on the weekend, that Minister Bridges said that he thinks it was one of the "earliest iterations of business case", that it was "materially wrong", and a "very early wrong business case in terms of its numbers"**. So can we take from this that there was an additional, fourth, business case that has more up-to-date figures?

“Wiri to Westfield – The Case for Investment” is a final draft business
case that KiwiRail included in its Crown funding proposals for FY17/18. 
KiwiRail collaborated with NZTA and Auckland Transport during the
preparation of the document, but neither of those agencies has formally
adopted or approved it. The business case is a KiwiRail document. The
document footer naming NZTA is a formatting error and NZTA should not be
considered to be the author of the document.

The Ombudsman's investigation into the processing of Harriet's OIA request, and a model protocol on dealing with OIA requests involving ministers:

“I have formed the opinion that while KiwiRail did not act in a manner that was wrong,
