Official information request: Aviation Safety and RPAS (Remotely Piloted Aircraft Systems – ‘drones’) – Enforcement

Please supply the following information under the Official Information Act (OIA):

The objective of the Civil Aviation Authority (CAA) is to undertake its safety, security, and other functions in a way that contributes to the aim of achieving an integrated, safe, responsive, and sustainable transport system.

Enforcement of laws, Rules and Regulations may be required to achieve those functions and aims.

For RPAS-related ‘Occurrences’ and ‘Events’ reported to them, the CAA at times advises, notifies, and otherwise engages the Police; in some instances the Police are already engaged in investigation, before CAA is involved

For the periods 2014, 2015, 2016
And for the period to date of 2017

Please provide details of any prosecutions the Police has undertaken under the Civil Aviation Act, against operator(s) of RPAS

Please also provide details of any other legal actions the Police has undertaken under the Civil Aviation Act, against operator(s) of RPAS

Similarly, please also detail any prosecutions or other legal actions the Police has undertaken under any other legislation, against operator(s) of RPAS – for example, Privacy laws…

Such actions, past or current, may include, but not be limited to – prosecutions thru the courts; appeals; injunctions; removal of certifications; written-, email- or verbal-warnings…

Details requested –
- date and time
- location
- RPAS details
- other aircraft details, if any
- nature of the incident – the reason for the action(s)
- agencies involved – eg. CAA, Police, TAIB, military…
- nature of the action(s)
- outcomes – eg. Court case, fines, not proven…

The CAA has recently provided a listing of RPAS Occurrences. There is only one court action listed – there may be more.

If you need any more information from me please let me know as soon as possible.

I understand that a decision on a request for information under the OIA should be made within 20 working days of receiving that request.

Thank you for your timely reply

However, 'don't know, can't know' as a response, is a little disappointing. Perhaps, it is indicative of the rarity, or even total absence, of such action

Whilst I specifically mentioned the Civil Aviation Act and Privacy laws, I did also say "any other legislation" - your letter reads as if the Civil Aviation Act plus Privacy laws ONLY was the 'first search level', and then 'RPAS' was the next; totally ignoring any other legislation - confirm please

And, laser strike incidents are nothing to do with RPAS ('drones')

PLEASE EXPLAIN how you came to your response in 'Reynolds Allen 173144 reply.pdf', the search methodology.

Did you FIRST search for prosecutions and other legal actions involving RPAS?
Or, did you FIRST search for prosecutions and other legal actions under JUST the Civil Aviation Act?

Did you ACTUALLY SEARCH for prosecutions and other legal actions under ANY OTHER legislation?
And, have there been any? - for period 2014, 2015, 2016, and 2017 to date?

Your response is overdue; please respond forthwith
