Beginning in April 2015, Marlborough District Council (MDC) engaged in a number of activities related to improving broadband in the Council's footprint.

Can you please release some information about those activities?

1.) The members of the Steering Group
2.) Times and dates of all Steering Group meetings
3.) Transcripts and/or meeting notes of all Steering Group meetings
4.) MDC's ROI Response-Support document submitted to MBIE
5.) MDC's Alternate Approach Document seeking Crown funding (all revisions)
6.) MDC's Digital Enablement Plan
7.) Times and dates of all community engagement activities
8.) Transcripts and/or meeting notes from all community engagement activities
9.) Any reports submitted to MDC by Creative Development Solutions
10.) Times, dates, and attendance lists of any closed or "invite-only" meetings
11.) Transcripts and/or meeting notes of all closed or "invite-only" meetings

I refer to your email of 10 October 2016 and note the 20 working days’
deadline under the Information legislation would be 9 November 2016.

 

This is to confirm that I am working through your request but at this
stage have yet to receive the information so a decision can then be made
about release or withholding in full or in part.

 

It is unlikely I will have the information by 9 November and I therefore
need to extend the time period until Tuesday 29 November.  A complication
is that I am overseas for a period in mid-November.

 

Please note you are entitled to seek review by the Office of the Ombudsman
about the time extension.   The office that deals with this Council is in
Wellington, the address being Office of the Ombudsman, P O Box 10152,
Wellington 6143.

 

For your information it is so I may firstly get the information and then
seek input from the party about whom the information is based.  This is
not determinative of any decision, merely an opportunity for a party
affected to provide comment that I can take into account.

 

Within the extended time frame I may need to address any charge based on
Council’s Release of Information Policy.  No such decision has been made
but if considerable resource is needed, it is something to be considered.

I refer to my email of 2 November and to the two phone messages you left
for me while I have been away from the office.

 

We are doing what we can to at least have a decision available by 9
November in terms of what information may be available for release.

 

Based on the time already expended in extracting information there will be
costs levied for which we will need payment.  Council’s Cost Policy sets a
rate of $60 per hour for recovery.  The basis of the policy is that the
requestor, as the beneficiary, should pay rather than the ratepayers of
Marlborough.

 

I will  let you know by 9 November 2016 about whether I am in a position
to make a decision but if not then the time extension would be put in
place.  That would then leave it open for you to seek review by the Office
of the Ombudsman.

 

Discussion is of little benefit unless it is to cut back on the
information requested.  The difficulty is firstly pulling together all the
information and secondly seeking and considering any comments from the
party affected.

attendees, Working Group attendees, meeting notes 22 June 2016, 29
September 2016 and 7 July 2016.  I have considered the information and it
will be available for release but there are matters redacted from the
meeting notes of 7 July 2016 for reasons of confidentiality and privacy.

 

Council has expended 5 hours in resource meeting your request which under
the policy would involve a charge of $300.  The charge, however, will be
