Given I am still interested in BN2026/125, I would like to know if there are any grounds that would prevent the release of either a redacted version of the document or a summary of the document (as is a valid form to provide information in under Section 16(1)(e))

Dear Marcus,
Thank you for your follow-up request regarding BN2026/125.
We have considered whether the information could be made available in
another form under section 16 of the Official Information Act 1982 (OIA),
including by providing a redacted version of the document or a summary of
its contents under section 16(1)(e) of the OIA.
In this case, the information has been withheld under section 9(2)(h) of
the OIA to maintain legal professional privilege. Legal professional
privilege protects confidential communications made for the purpose of
seeking or providing legal advice, and the privilege extends not only to
the full text of the advice but also to information that would reveal the
substance, content, conclusions, or tenor of that advice.
We have considered whether any information could reasonably be released in
a redacted form or provided as a summary. However, we consider that doing
so would disclose, or enable inferences to be drawn about, the substance
of the legally privileged advice.
We have also considered the public interest in release, as required by
section 9(1) of the OIA, and do not consider that any public interest
considerations outweigh the need to maintain legal professional privilege
in this instance.
