1. Total Complaints: The total number of complaints/concerns recorded relating to staff conduct (counted as unique matters or cases, where applicable), broken down by:
• Category: e.g., harassment, bullying, discrimination, harmful sexual behaviour, etc., or equivalent used by The University. Please note if any complaints fall under multiple categories.
• Complainant Type: Student, staff, or external/third-party.

2. Progression & Status:
• The number of matters that proceeded to a formal investigation.
• The number of complaints currently closed vs. still in progress.

3. Review & Appeals:
• The number of cases where an internal appeal or review of the investigation/outcome was requested.
• The number/percentage of those requests that were granted.

4. Timelines: The average (mean and/or median and where possible, spread measures) time from the initial concern being raised to the conclusion of the formal investigation.

5. Outcomes:
• The number of complaints by outcome: withdrawn, not upheld, partially upheld, or fully upheld findings
• The number of cases resulting in: (a) formal disciplinary processes, (b) an instruction to improve/informal action, or (c) no action taken against the staff member.
•The number of cases resulting in a finding of serious misconduct (or equivalent classification, if used)

6. External Escalation:
• The number of cases where an external third-party process has been initiated (e.g., the Office of the Ombudsman, Office of the Privacy Commissioner, Human Rights Commission), where such information is centrally recorded or tracked
• Of those, how many are currently open vs. closed
• For closed cases, how many resulted in a substantiated or confirmed breach

complaints/concerns for the 1 January 2025 to 5 April 2026 period, in
respect of the following categories: bullying, harassment, and
discrimination. We have decided to provide you with the full-year totals
for 2025; the requested totals for the 1 January 2026 - 5 April 2026
custom period are withheld under section 9(2)(a) of the OIA, to protect
the privacy of the relevant persons.
Our decision to provide these full-year totals for 2025 is subject to the
following:

* We hold information about the primary category of the complaint only,
and not whether a complaint falls under multiple categories.
Complaints/concerns are categorised by the identity of the respondent,
and depending on the nature of the specific case multiple
complaints/concerns may be grouped into one matter, or a single
complaint/concern may give rise to multiple matters – therefore we do
not hold information that always counts each complaint/concern as a
unique matter or case.
* Where the number of items falls under our privacy threshold of 7, we
do not provide further breakdowns to protect privacy of the relevant
persons, under section 9(2)(a) of the OIA.

The University holds information on the total numbers of

be provided under section 9(2)(a) of the OIA, to protect the privacy of
natural persons.
The University does not hold statistics identifying a distinction between
fully or partially upheld complaints. We do not hold statistics regarding
whether informal action was taken (including but not limited to an
instruction to improve), or no action was taken against the staff member.
These parts of your request are refused under section 18(g).

be provided under section 9(2)(a) of the OIA, to protect the privacy of
natural persons.

 

The University does not hold statistics identifying a distinction between
fully or partially upheld complaints. We do not hold statistics regarding
whether informal action was taken (including but not limited to an
instruction to improve), or no action was taken against the staff member.
These parts of your request are refused under section 18(g).

applicable), broken down by:
• Category: e.g., harassment, bullying, discrimination, harmful sexual
behaviour, etc., or equivalent used by The University. Please note if any
complaints fall under multiple categories.
• Complainant Type: Student, staff, or external/third-party.

2. Progression & Status:

Dear Legal,

Further to my request for information on staff conduct complaints, I am seeking a refinement of your response and refusals under the Official Information Act 1982.

Where complaint counts fall below your privacy threshold, I request that these be indicated as “<7” rather than withholding the existence of the category entirely.

For complaints closed during 2025 only, please provide outcome totals using your existing internal categories (e.g. withdrawn, not upheld, upheld/partially upheld, disciplinary process initiated). Where any outcome category falls below your suppression threshold, I request that these be reported as “<7”, consistent with the reporting approach outlined in your response. This request excludes all open or ongoing matters.

As the information sought is aggregate statistical data rather than case-level information, and any small-number categories can be reported as “<7”, it is unclear how disclosure would identify any individual. I therefore request reconsideration of the application of section 9(2)(a) to these figures.

This request is also made in light of the strong public interest in transparency regarding the handling of staff conduct complaints within a publicly funded university, particularly in relation to bullying, harassment, discrimination, and related matters. I request that any application of section 9(2)(a) be weighed against the public interest considerations under section 9(1) of the Official Information Act 1982.
