This line appeared near the bottom:

> We commissioned an independent review of our public complaints and enquiries functions, which considered the growing demand for our services, our constrained resources, the risks to staff, and new technological developments (such as AI). We decided that we need to prioritise resolving privacy harms and maximise our limited resources.

I would like to request a copy of the findings of this independent review. Presumably there was some sort of final report available in PDF form which is what I would be after.

This response was a bit odd, not just because it states the final report is not public (despite this being an Official Information Act to make it public) but there are also no relevant sections of the OIA cited.

If, in the Office of the Privacy Commissioner's view, the report summary meets the criteria of the information being public, they should "reject" my request with the relevant Section of 18(d)

I'm going to follow up to ask them to issue a proper response

Dear OIA,

Thank you for providing your reply although I'm a bit confused.

You mentioned that "The full report is not publicly available, however, your request for the report findings is met through the public availability of the findings."

While I did mention asking for "a copy of the findings", I think it's reasonably interpretable that by "Presumably there was some sort of final report available in PDF form which is what I would be after", I had meant that I was after the final report in full.

For the avoidance of doubt, I would like to request a copy of the full report which is not currently available to the public but should fall within the realm of requestable official information given that MartinJenkins was commissioned by the Office of the Privacy Commissioner (Section 2(5) of the Official Information Act)

I also note that I don't think your reply actually meets the criteria for a "decision" under Section 15(1)(b) of the Official Information Act, in that it's unclear to me whether my request has been accepted or denied.

If it was denied, my impression is that the request has been denied under Section 18(d). Not that it's a relevant factor here but as far as I understand, the report summary was not available at the time of request going off the date in the filename.

If the request is denied, I would like to request the grounds under Section 19(a)(ii) of the Official Information Act for what the decision is for the original response, and whether there was a decision made in regards to releasing the wider report.
