charann made this Official Information request to New Zealand Police
The request was refused by New Zealand Police.
From: charann
Dear New Zealand Police,
I am the poster of the video that has now gone viral of the officer that punched the guy in the face. Since you guys have said he shoved the officer to cause the punch I would like to see this footage. Since I was there and witnessed this event from only meters away and never seen him resist, be aggressive or uncooperative, let alone shove this officer I would like to see where you guys have based these allegations from.
Yours faithfully,
Charann poinga
New Zealand Police
Hi Charann - thanks for your email. I have forwarded it to the Inspector
in Christchurch who is looking after this case, and I've asked him to get
back to you directly.
Regards,
Public Affairs

Dear ERASMUS, Derek,
To be honest, after what I witnessed I am actually scared to come in. I don't want to put myself in a situation where I feel intimidated by those that are meant to serve and protect. And in response to your reply this is exactly how it makes me feel. Especially after that cheeky unprofessional remark. If there is nothing to show then why hasn't the footage been released in response to the video I posted to clear this all up instead of letting proceed to national television? Is there anyway I can send someone on my behalf otr have it emailed. I'm more then happy to sign waivers so I can't release the footage.
Yours sincerely,
charann

I am very happy for you to nominate a person to come and view the footage. If they contact me on the number below and we will arrange it.
As I said, Police do not own the footage and cannot release it (as much as we would like to).

Dear ERASMUS, Derek,
I think its a bit cheeky to bring up his past history to destract viewers from the truth. What's next? My past? I guess what done is done, you guys are in the clear, as usual. To say your going to release the footage then don't? And then call me out pubically to view the footage knowing very well why I won't? Don't worry this will be all soon forgotten. Just goes to show who our police force are. I just hope that one day we can all learn to trust the nz police force once again.
Just so you know I am all for the arrest, he shouldn't have been there. But to lie and say he shoved an officer? That he was agitated? If this was the case then why was he allowed to walk out uncuffed. Anyway I wish you all the best, and hope this never happens to me.
Yours sincerely,
charann

I will retain the footage for you to view if you change your mind. In the opinion of those in the media who have seen the footage, there was no punch. I know you have a different point of view and that's why a look at the footage would be advantageous.
We obviously have a difference of opinion on what happened!

If they can show it to you then they have a copy. If they have a copy, then it is "held". And as they are an agency, then anything they hold is "official information" and must be released unless there is good reason to withhold it.
Given that the police response does not provide good reason in terms of the Act, I suggest a complaint to the Ombudsman.
