REQUEST FOR INFORMATION - LOCAL GOVERNMENT OFFICIAL INFORMATION AND
MEETINGS ACT 1987: ACKNOWLEDGEMENT OF REQUEST

 

I am writing to acknowledge receipt of your official information request
dated 17 December 2025, for information on complaints and related
communications regarding 1044 Coast Road. Specifically, you requested:

 

 1. Copies of all complaints received by Hutt City Council about 1044
Coast Road that have not already been provided to your FYI account.
 2. All communications to and from Council, including (but not limited to)
complaints about compliance with the Resource Management Act 1991 and
the Hutt City Council District Plan.

 

However, your current request is very broad and could involve a large
volume of information. Section 17(f) of the LGOIMA allows Council to
refuse a request if the information cannot be made available without
substantial collation or research. To avoid that outcome, we’d like to
work with you to clarify and narrow the scope.

 

Please can you confirm: the date range you’re interested in, whether you
are seeking complaints alleging non‑compliance or all communications about
compliance, any topics or activities under the Resource Management Act or
the District Plan that you wish to focus on, any locations or consent
numbers, and whether you want external communications to and from Council
only or also internal emails and notes.

 

We will endeavour to respond to your request as soon as possible, and no
later than 4 February 2026. Please note that this timeframe takes into
account the LGOIMA summer holiday period, which runs from 20 December 2025
to 10 January 2026. Additionally, if clarification changes the scope of
your request, the due date may also change, and we will advise you
accordingly.

 

We note that you have previously received three responses from Council
regarding 1044 Coast Road. Additionally, you have an ongoing request, due
for response on or before 22 January 2026, which asks: “Please provide
copies of all submissions of notified parties for the proposed cleanfill
at 1044 Coast Road”.

 

Please note that we may publish our response to your request, including
your name, on Council’s website if we consider there is a public interest
in sharing the information provided to you. You can view published

I’m following up on the second part of your official information request
dated 17 December 2025, which asks for:

 

“All communications to and from Council, including (but not limited to)
complaints about compliance with the Resource Management Act 1991 and the
Hutt City Council District Plan.”

 

As written, this would require searching for correspondence across
multiple systems and decades, which would involve substantial collation
and research. To avoid that outcome and make sure we provide the
information most relevant to you, could you please confirm a specific date
range (for example, the last 12 months or a particular consent period)?

 

If we don’t hear back by 9 January 2026, we may need to refuse this part
of your request under section 17(f) of the LGOIMA, as it cannot reasonably
be made available without substantial collation or research.
