Act (LGOIMA) 1987
We refer to your official information request dated 17 December 2025, seeking
copies of complaints and related communications regarding 1044 Coast Road.
Specifically, you requested:
1. “Please provide copies of al complaints received by Hutt City Council
about 1044 Coast Road that have not already been provided to this FYI
account.
2. Please provide al communications to and from the council, including, but
limited to, complaints about compliance with the Resource Management
Act 1991 and the Hutt City Council District Plan.”
For clarity, the phrase “including, but limited to” in part two of your request has
been read in its standard form, “including, but not limited to”, when preparing
this response.
We wrote to you on 19 December 2025 to seek clarification because part two of
your request was very broad and would have required searching across multiple
systems and many years of records. We asked you to confirm the timeframe you
were interested in, the topics or activities you wished to focus on, and whether
you sought external communications only or also internal Council emails and
notes.

As we did not receive a reply, we followed up again on 6 January 2026 and
advised that if clarification was not received by 9 January 2026, some aspects of
the request might need to be refused. However, no clarification was received.
Answer:
In response to point one of your request, the Resource Consents and Compliance
team reviewed the monitoring, enforcement, and customer request records they
hold for 1044 Coast Road. This is the team primarily responsible for responding to
complaints and compliance matters relating to activities at the site. Ten
complaints were identified through this process and are enclosed with this
response. Personal contact details have been withheld under section 7(2)(a) of
the LGOIMA to protect the privacy of the individuals concerned.
To avoid unnecessary duplication, we have not included correspondence that
originated from you, as you already hold this information and reproducing it
would not provide any additional official information.
We are also releasing submissions and other correspondence received in
relation to the cleanfil consent at 1044 Coast Road. These have been provided in
the appendices titled “Submissions” and “Other Acknowledgements”. Personal
contact details have also been withheld from these documents under section
7(2)(a) of the LGOIMA.
In response to point two of your request, without the clarification we sought it
would have required the collation and review of at least 35 years of
correspondence relating to the Resource Management Act 1991 and the District
Plan. Over that period there have been thousands of monitoring and compliance
matters and a large number of resource consents, each generating internal and
external communications. This would involve substantial collation and research
across multiple systems. For this reason, and after taking reasonable steps to
consult with you to refine the scope, we are refusing this part of your request
under section 17(f) of the LGOIMA because the information cannot be made
available without substantial col ation and research.
